Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care Assisted Living Act (CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Furniture, equipment and fixtures were in disrepair, including:
- A light fixture in the ceiling had a panel missing exposing the florescent tubing and fixtures
- the filled in pool area located outside the daycare door is overrun with weeds.
- a panel located along the bottom of the shed in the outdoor play yard is showing significant wear and water damage.
Corrective Action(s): Ensure the facility is clean and in good repair

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation (CORRECTED DURING INSPECTION): Many household items were stored in the carport and were seen to be blocking the emergency exit
Corrective Action(s): Ensure emergency exits are not blocked

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): The following hazards and substances were located in the facility:
- medication was stored on the counter of the facility washroom and was accessible to children
- several covers located in the children's nap room had bee removed and replaced with charging plugs for electronic devices. These were at a level accessible to children.
- plastic bags were stored and accessible to children in a cupboard in the nap room and under the sink in the children's washroom.
- cleaning products were stored under the unlocked sink in the kitchen
Corrective Action(s): Ensure children do not have access to objects or substances that may be a hazard.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A review of staff documents found that the manager and staff member had criminal record checks that had expired earlier in the year.
Corrective Action(s): Ensure all staff have a valid Criminal Record check on file

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for one of the employees
Corrective Action(s): Ensure staff files are complete

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained
Corrective Action(s): Ensure staff files are complete

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: A review of staff documentation found that there was no proof of compliance with the Province's immunization program.
Corrective Action(s): Ensure staff files are complete

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: A review of the facility file found that a person who is over the age of 12 and normally present at the facility did not have a valid criminal record search on file. The previous Criminal Record search had expired earlier in the year
Corrective Action(s): Ensure all persons over the age of 12 who are normally present at the facility have a valid Criminal Record search on file.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: - Single use towels were not available for children in the washroom. Wash cloths used for cleaning were hung to dry on the towel rack meant to hold the paper towel rolls. The licensee removed the cloths and hung paper towel rolls during the inspection.
- children's tooth brushes were stored in a basket in the washroom with each of the tooth brush heads touching. A hair brush was also located in this basket along with a prescription bottle.
Corrective Action(s): - Ensure children have access to single use towels to dry their hands after hand hygiene
- Ensure children's toothbrushes are not stored where they touch each other or with other washroom items.

Comments

During this inspection, there were 5 children and 1 staff present. At this inspection, the above noted contraventions were identified. Actions required by the licensee and actions required the LO included here. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The Licensing Officer met with the manager and discussed the following:
Age appropriate use of highchairs
Multi- Age and In Home Multi-age licensing categories
Temporary plan for accessing the outside play area
Criminal Record Review Program

This report was written off site; therefore, no signatures were captured at this time. Time reflects onsite visit. A copy of this document will be provided to the facility via email.
