Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All areas of the facility were inspected for compliance.

Contraventions
Previous Inspection - Contraventions observed on FIR #JMI-AW2NL5 have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11080 - CCLR s.15(1)(a) - A licensee must supply equipment, furniture and supplies that are (a) of sturdy and safe construction, easy to clean and free from hazards.
Observation: Two pieces of furniture as used for storage and have several heavy items stored on them. These shelves are not affixed to the wall and could pose a risk to the children in care playing in the area in the event of an emergency.
Corrective Action(s): Ensure equipment, furniture and supplies are sturdy and free from hazards.
Date to be Corrected: February 11, 2019

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Four staff files were reviewed and two staff did not have a record of their work history.
Corrective Action(s): Ensure staff files are complete including all staff working with the children have resumes. This is a repeat contravention.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Four staff files were reviewed and three staff did not have evidence of immunization status.
Corrective Action(s): Ensure all staff files are complete including immunization status.

STAFFING: 12100 - CCLR s.19(2)(a) - A licensee must not employ a person in a community care facility unless the licensee is satisfied, based on the information available to the licensee under subsection (1) and the licensee's or, in the case of an employee who is not the manager, the manager's own observations on meeting the person, that the person (a) is of good character.
Observation: Four staff files were reviewed and all four staff did not have evidence that personal references checks were conducted.
Corrective Action(s): Ensure staff files are complete including staff character references.
Date to be Corrected: February 11, 2019

STAFFING: 12460 - CCLR s.60(3)(b) - A licensee must keep (b) in any other case, all criminal record check results and character references for the entire time that the subject of the criminal record check or character reference is ordinarily present on the premises.
Observation: An additional staff person was on site during the inspection cleaning the facility while the children were in care. This individual did not have a record of a Criminal Record Check being completed.
Corrective Action(s): Ensure criminal record checks are completed for individuals who are ordinarily present and on premise at the facility.

Comments

Summary of Inspection
On the inspection date of February 5, 2019 there were 19 children and 3 staff present. At this inspection the above noted contraventions were identified. Actions required by the licensee include that a Corrective action plan is required to be submitted and actions required the LO include to review and monitor the corrective action plan. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
