Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Contraventions

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Licensing observed the outdoor play area and identified the following: (This is a repeat contravention, which was identified on Jan. 25, 2022 on inspection report #MZIN-CB2NNE).
- A sharp gardening tool was accessible to children which was placed on top of an outdoor furniture
- A rake and a shovel were leaning against the wall and fence which could potentially fall on children

Licensing also observed the following indoors in the kitchen area:
- a boxed wine with a tap was accessible to children which was stored on an open shelf under the kitchen countertops.


Corrective Action(s): During the inspection, these items identified were corrected during the inspection and stored in a place not accessible to children.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing observed that the manager was missing their character references on file.
Corrective Action(s): Ensure that the manager's character references are available on-site.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the manager's work history was not obtained during inspection.
Corrective Action(s): Ensure that the work history (resume) of the manager is available on-site.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for the manager.
Corrective Action(s): Ensure that the manager's immunization status is included on file and available on-site.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed that the last time children's attendance were recorded was back in January 2022. The manager said that the attendance of children has not been recorded for some time.
Corrective Action(s): Ensure that the attendance of children are recorded daily with their name, time of arrival and departure. If the child is absent, this should also be recorded.

Comments

At the inspection dated Nov. 25, 2022 there were 5 children, and the manager was on-site and assisted with the inspection. The above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the manager during the inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations/discussions were provided:
- Continue to clean and sanitize (outdoors and indoors) the facility including toys and equipment
- Continue hand hygiene procedures
- Remove all items with a DIN # in the first aid kit, as parent’s permission is required before using these items on children. Mild soap and water can be used to clean any minor cuts or scrapes.
