Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Evidence of references being checked for one staff was not available.
Corrective Action(s): Please ensure evidence of a minimum of two references being checked is available for all staff.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A criminal record check was not available for one staff. The Assistant Manager it had been applied for although a copy was not at the facility.
Corrective Action(s): Please ensure a criminal record check is available for all staff.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Copies of any diplomas, certificates or other evidence of the person's training and skills were not available for one staff.
Corrective Action(s): Please ensure evidence of staff qualifications is available for all staff.

Comments

Summary of Inspection
At the inspection dated January 5, 2024 there were five children and two staff present. At this inspection the above noted contraventions were identified.. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the Assistant Manager and a copy will be emailed to the manager.
The following were discussed:
A Licensee must replace an absent staff if they are absent for 30 or more consecutive day. Section 37(1)(b) Child Care Licensing Regulation.
