Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), The Child Care Licensing Regulation (CCLR) and the Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the Manager was not posted in the facility. This is a repeat contravention from inspections: # CLAN-CQLQJ3, #CLAN-CD8M9B, #CLAN-CEJLZL, #CLAN-CFPT8Z
Corrective Action(s): Please ensure the Manager's name is posted in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the landscape fabric in the outdoor play area was exposed. This could present a potential tripping hazard. This is a repeat contravention from inspections: #CLAN-CQLQJ3 #CLAN-CD8M9B, #CLAN-CEJLZL, #CLAN-CFPT8Z.
Corrective Action(s): Please ensure the facility is in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The laundry room door was unlocked. A lock was present but it was not applied. A stool was in the laundry room with access to various cleaning products. This is a repeat contravention from inspection # #CLAN-CQLQJ3, #CLAN-CD8M9B, #CLAN-CEJLZL, #CLAN-CFPT8Z. This was corrected during the inspection.
-Disinfectant wipes labelled, keep out of the reach of children, were located at the children's level.
-A staff purse was observed on a low shelf in the kitchen. This is a repeat contravention from inspection #CLAN-CQLQJ3
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to their health and safety.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: Licensing measured the water temperature in the washroom where children wash their hands. The temperature was 53.1 Degrees Celsius. This is a repeat contravention from inspection # CLAN-CQLQJ3
Corrective Action(s): Please ensure the water temperature does not exceed 49 Degrees Celsius to meet the legislative requirement and ensure the health and safety of children in care. Please provide active supervision in this area until this is corrected.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Staff records were reviewed. Two staff records did not have a site specific Criminal record check (CRC).
Corrective Action(s): Please ensure CRC's are site specific.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Staff records were reviewed. One staff was missing a character reference. This is a repeat contravention from inspection #CLAN-CQLQJ3, #CLAN-CEJLZL, #CLAN-CFPT8Z

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation (CORRECTED DURING INSPECTION): During the inspection a staff arrived with her current certificate. Her previous certificate was expired and not on site although she had been working at the facility since July

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Staff records were reviewed and two staff and the Manager did not have a verification for their certificate on file. This is a repeat contravention: #CLAN-CFPT8Z, #CLAN-CEJLZL, #CLAN-CD8M9B. This process was reviewed with the staff at the inspection.
Corrective Action(s): Please ensure staff records are complete.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The fire extinguisher was due for servicing on November 2023. The fire extinguisher was observed as being within the area of fully charged. This is a repeat contravention from inspection #CLAN-CFPT8Z, #CLAN-CEJLZL, #CLAN-CD8M9B, .
Corrective Action(s): Please ensure the fire extinguisher is serviced on an annual basis before the expiry date to be able to respond in the event of an emergency.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: The policies and procedures were reviewed during the inspection. The following policies were not present at the facility:

-Behavioural guidance, Nutrition Policy, Repayment policy, Active Play, Screen use.
Corrective Action(s): Please ensure policies are located at the facility.

NUTRITION AND FOOD SERVICES: 17120 - CCLR s.48(6) - A licensee must make available to parents information on the food and drink given to children.
Observation (CORRECTED DURING INSPECTION): The food menu was observed at the facility. The menu was written in Chinese characters. The food menu must be written in English as well as Chinese characters. This is a repeat contravention from inspection # CLAN-CD8M9B and # CLAN-CEJLZL.
Corrective Action(s): Please ensure the food menu is written in English as well as Chinese characters.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: The children's records were reviewed. One child's record was missing an emergency contact other than the parent
Corrective Action(s): Please ensure to obtain an additional emergency contact for the child's record.

Comments

At the inspection dated December 21, 2023 there were 5 children, 2 staff and 1 volunteer were present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by December 29, 2023 unless otherwise specified in the report. The Director or Manager is required to submit a written plan detailing how the contraventions have been corrected by December 29th at 9:00 am. As part of the inspection the Facility Risk Assessment Tool is completed and a copy was provided to the Manager.

The following was discussed:
-The reportable incident reporting procedure. Forms and the bulletin were given
-The current cleaning protocols that are in place
-Preventing lead in the water
-Adding a CRP mask to the first aid kit
