Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the routine inspection of the outdoor playground the following were noted:
- two Little Tikes were present on the playground. They did not have enough clearnce zone.
- two piles of dog feces were on the playground under the tree
- few holes approximately 5 inches in length and 3 inches in depth were present on the playground causing a tripping hazard
- a watering hose was present in the back yard causing a tripping hazard
- a broken plastic shovel with sharp edges was present in the corner of the playground
- several pieces of a sharp plastic lid were present in various areas of the playground
- in one of the corners of the playground there were a few broken plastic items. Manager said she has piled the items to be taken to the dump over the weekend.
Corrective Action(s): Please ensure you provide a healthy and safe environment while children are present at the facility.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: During the routine inspection it was noted that the staff did not have a record of immunization present.
Corrective Action(s): Please enure staff files are complete.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: During the routine inspection it was noted that the fire extinguisher was not serviced annually. This is a repeat contravention from 2022.
Corrective Action(s): Please ensure the fire extinguisher is reviewed annually.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: During the routine inspection it was noted that a log of minor accidents was not present. Manager said that she communicates via text with parents when small injuries take place and does not have a log book.
Corrective Action(s): Please ensure a log of minor accidents is available and maintained.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: During the routine inspection it was noted that one child's file was not available.
Corrective Action(s): Please ensure all children's files are kept at the facility and available.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During the routine inspection 3 children's files were reviewed and one child's file was missing a record of immunization.
Corrective Action(s): Please ensure all children's files are complete.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: During the routine inspection three children's files were reviewed and one child's file was missing a date of enrollment. This is a repeat contravention from 2022.
Corrective Action(s): Please ensure all children's files are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: During the routine inspection it was noted that the times including arrival and departure times were not available.This a repeat contravention from 2021.
Corrective Action(s): Please ensure attandance and departure times are present in your daily attendance.
Date to be Corrected: Immediately.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: During the routine inspection three children's files were reviewed and one child's file was missing a photo of the child.
Corrective Action(s): Please ensure all children's files are complete.

Comments

At the inspection dated February 07, 2023 there were 4 children and 1 staff present. At this inspection the above noted contraventions were identified. Actions required by the licensee and actions required the LO included here. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
· Promoting Active Play in the program
· A conversation was had regarding emergency supplies.
· Active Supervision
· Lead in the water
