Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were reviewed for compliance.

Contraventions
Previous Inspection - Not Applicable
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11080 - CCLR s.15(1)(a) - A licensee must supply equipment, furniture and supplies that are (a) of sturdy and safe construction, easy to clean and free from hazards.
Observation: While on site the following were observed:
-sharp knife in kitchen drawer, within reach of the children- corrected on site
-bike with broken edges on front fender and back fender- corrected on site
-large bucket outside with broken edges within reach of the children- corrected on site
-nap mats with torn corners, which make the mats difficult to sanitize- Licensee states will have them repaired by February 5, 2019
Corrective Action(s): Please ensure all equipment, furniture and supplies are free from hazards and are easy to clean
Date to be Corrected: February 5, 2019, 2019

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Two out of four files reviewed were missing references. The Licensee stated that she did talk to other people who had worked with the staff previously.
Corrective Action(s): Please ensure all staff have 3 references on file that have been checked by Licensee.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: One out of four staff files reviewed was missing a resume.
Corrective Action(s): Please ensure all staff have a resume on file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): One out of four staff files reviewed was missing immunization status. This was corrected during the inspection.
Corrective Action(s): Please ensure all staff have immunization status documented on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Although all staff do have current certification, it needs to be validated online through the ECE registry in Victoria.
Corrective Action(s): Please validate all staff's credentials online and keep proof of validation on file.
Date to be Corrected: February 8, 2019.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: One person who lives in the home has applied for a criminal record check through Victoria, but has not yet received the results.
Corrective Action(s): Please ensure all people over 12 who live in the home have a current criminal record check.
Date to be Corrected: As soon as possible.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: Two of the five children's files reviewed were missing parental consent to seek medical attention if required.
Corrective Action(s): Please ensure all children's files have parental consent to seek medical attention.

Comments

Summary of Inspection
At the inspection dated January 28, 2019 there were 10 children and 3 staff present. At this inspection the above noted contraventions were identified.
Actions required by the Licensee:
Take corrective action by bringing facility into compliance
Provide a written response to Licensing
