Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing observed that two staff did not have their character references on file.
Corrective Action(s): Ensure that staff files are updated and complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing observed that one staff did not have their certificate validation on file.
Corrective Action(s): Ensure that certificates are validated by the system in place by the ECE registry.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that for the year 2023, the emergency log was not documented on file, though the manager said during the inspection that the emergency drill was completed with the children.

This item was previously contravened on Jan. 14, 2022 on inspection report #MZIN-CARNXR.
Corrective Action(s): Ensure that emergency drills are completed yearly and documented.

HYGIENE AND COMMUNICABLE DISEASE: 15010 - CCLR s.14(4)(a) - A licensee, other than a licensee who provides a care program described as either Preschool (30 Months to School Age) or Group Child Care (School Age), must have in a community care facility a sturdy surface for changing diapers, located outside the food preparation area, next to (a) a covered container for soiled clothing.
Observation: Licensing observed that in one clsssroom the container for the soiled diaper did not have a lid.
Corrective Action(s): Ensure that soiled diapers are disposed in a container with a lid cover.

Comments

At the inspection dated Jan. 16, 2024 there were 38 children, 12 staff and 1 behaviour interventionist present.The manager assisted and was on-site for both inspection dates. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the facility during the inspection.

On Jan. 22, 2024, Licensing completed the inspection with a practicum student.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following recommendations/discussions were provided:
- Reportable Incident procedures which is to be reported within 24 hours
- Continue to document minor incidents using the incident log bound book, and take note of any illness and unexpected events involving children not requiring medical attention, and that are not reportable incidents as described in Schedule H and staff to initial and write the date after each documentation
- Continue to clean and sanitize the facility including toys and equipment
- Spacing of water bottles
- Outdoor maintenance
