Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standard of Practice (DOLSOP). All eight care categories were assessed for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed:
-The way the nap mats are stored cause the children's linens to touch.
-There is an unsecured blind cord next to a crib in the naproom. The cord is accessible from the crib.
-There is a pillow with a fabric cover on the change mat. Anything used while changing children's diapers should be immediately sanitizable.
-There was no paper towel or other means of drying hands as part of a complete handwashing routine.
Corrective Action(s): Ensure a healthy and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed:
-The latch on the gate which leads to the street does not latch properly.
-The change mat was ripped in several places exposing foam.
-A piece of play equipment had a ripped cushion, exposing foam.
Corrective Action(s): Ensure the facility, equipment and fixtures within it are clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed a gallon of hand sanitizer accessible to children in care by the front door.
Corrective Action(s): Ensure children do not have access to any object or substance that may be hazardous to the health or safety children.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing inspected 2 staff files and noted that one did not contain references.
Corrective Action(s): Ensure staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing observed 2 staff files and noted that one was missing an immunization declaration.
Corrective Action(s): Ensure staff files are complete.

HYGIENE AND COMMUNICABLE DISEASE: 15050 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: Licensing observed 6 children under 48 months of which 2 were under 2.
Corrective Action(s): Ensure the community care facility is operated in compliance with Schedule E of the regulation.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: A child who may require additional support did not have a careplan in place.
Corrective Action(s): Ensure that a care plan is developed in consultation with a parent of the child requiring extra suppourt and any person requested by the parent.

Comments

Summary of Inspection:
At the inspection dated January 24, 2023 there were 7 children in care with the Licensee. At the time of Licensing's arrival the Licensee was not on site. The Licensee had a responsible adult covering for them.
At the inspection, the above noted contraventions were identified.
Please provide Licensing with a written response, by the date noted below, stating how the identified contraventions will be addressed in order to ensure year round compliance.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed. A copy of the report and the corresponding Risk Assessment was emailed to the Manager.
The following items were discussed:
-The Licensee's Criminal Record Check expires in 4 days.
-Discussed developmentally appropriate use of high chairs.
-Discussed maximum capacity. Children, including the licensee's own children under the age of 12, on and off site are considered to be in care and part of maximum capacity.
Additional Information:
This report was written off site and is unsigned. All summary and contravention items were discussed with the Licensee before Licensing's departure.
