Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #WBET-AMQMUD have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the Manager is not posted in the facility.
Corrective Action(s): Please post the name of the Manager in the community care facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
-a water hose was laying on the ground in the back play area creating a potential tripping hazard.
-dirty diapers in plastic bags were placed outside next to the back door.
-a phone outlet with exposed wires was accessible to children.
-boxes of supplies were stacked about 5 feet high next to the sleeping area in the nap room with the potential to fall on a child.
Corrective Action(s): -Address the tripping hazard from the water hose in the outdoor play area.
-dispose of diapers in a garbage can.
-repair phone outlet and make inaccessible to children.
-Boxes of supplies should be stored at a safe height or be moved to an area inaccessible to children.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: 1 of 2 staff did not have evidence of ECEA certificate verification. The Licensee stated she completed it last year.
Corrective Action(s): Please verify ECE and ECEA certificates using the system established and maintained by ECE Registry.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: The Licensee stated that she has not documented an emergency drill.
Corrective Action(s): Please practice and keep a record of implementation of the emergency plan at least once a year.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The Manager stated that the food in the emergency kit is checked every 3 months. At time of inspection the Licensing Officer observed food that expired in 2016 and 2017.
Corrective Action(s): Please ensure you have supplies to respond to an emergency.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: The Licensee stated that she transports children in a vehicle to and from school. The Licensee stated she has not created a Transportation policy. The Licensee stated that she has created an active play policy but was unable to locate it for review by the Licensing Officer during the inspection.
Corrective Action(s): Please create written policy and procedure to guide employees while transporting children. Please create and implement an active play policy.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation: 2 of 5 children's files reviewed did not contain the date the child stopped attending the community care facility.
Corrective Action(s): Please ensure that the date the child stops attending the facility is recorded.
