Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:
· Licensing, Physical Facility, Staffing, Polices & Procedures, Care & Supervision, Hygiene and Communicable Disease Control, Medication, Nutrition and Food Services, Program, Records and Reporting
As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10010 - CCLR s.10(1) - Applicants for licences and licensees must notify a medical health officer immediately of any change in the information provided under section 9.
Observation: Families are accessing the Infant/Toddler program through the 3-5 program. When the facility was licensed the licensee stated that families would directly access the Infant/Toddler room through the program door. The manager stated that families do not like doing this as there is no parking beside this door.
Corrective Action(s): If there are any changes to information submitted in the licence application this must be approved by Licensing. A plan stating how families will access the Infant/Toddler must be submitted to Licensing on or before February 23, 2018

LICENSING: 10040 - CCALA s.7(1)(c) - A licensee must do all of the following: (c) display the licence in the prescribed manner.
Observation: The name of the manager is not posted in the facility.
Corrective Action(s): The name of the manager must be posted. Licensing suggests that the name of the manager is posted by the facility licence.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Staff certificates are not posted
Corrective Action(s): All ECE and ECE Assistant certificates must be posted in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: A vacuum cleaner, mop and a bucket with cleaning rags are being stored in the children's bathroom.
Corrective Action(s): Please store cleaning equipment in another place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During this inspection Licensing observed the following:
-There are small holes in walls throughout the facility exposing the gyp rock.
-The exit gate in the Infant/Toddler room has netting that is not attached to the door frame.
-Rough edges of shelving in the Infant/Toddler room are exposed as the tape covering them is peeling off.
Corrective Action(s): All areas of the facility must be in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Cords from the venetian blinds are accessible to children in the Infant/Toddler room and pose a choking hazard.
Corrective Action(s): The venetian blind cords must not be accessible to children.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A criminal record check from the Sharing Program of the Criminal Record Review Agency for 1 staff has not been applied for. This staff person has been working at the facility for 1 month. There is a copy of a criminal record check from another facility on file.
Corrective Action(s): Criminal record checks from other facilities must be obtained through the Criminal Record Review Agency sharing program.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: No proof of reference checks were available for 1 staff person.
Corrective Action(s): Proof of reference checks must be available for all staff.
Date to be Corrected: 23 February , 2018

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A resume is not available for 2 staff persons.
Corrective Action(s): All staff must have a resume in their file.
Date to be Corrected: 23 February, 2018

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status is missing for 2 staff.
Corrective Action(s): All staff must have immunization status in their file.
Date to be Corrected: 23 February, 2018

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: ECE certificates have not been validated for 3 staff.
Corrective Action(s): All ECE Certificates must be validated
Date to be Corrected: February 23, 2018

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Time out was not recorded for 2 children on February 8, and 1 child on February 9 & 14 in the Infant/Toddler program.
Corrective Action(s): time out must be recorded on a daily basis every day for each child.
Date to be Corrected: Today and ongoing.

RECORDS AND REPORTING: 19130 - CCLR s.57(2)(g) - A licensee must keep, for each child, a record showing the following information: (g) any notification of a parent, emergency contact or medical health officer made under section 55 [notification of illness or injury].
Observation: One child has no emergency contact.
Corrective Action(s): All children must have an emergency contact.
Date to be Corrected: 23 February, 2018


Comments

During this inspection Licensing talked to the manager about how the furniture in the program room could be rearranged to make a corridor for families to walk though instead of walking through the 3-5 program.
The manager was strongly encouraged to contact Licensing if she has any questions.
This inspection was reviewed with the manager and she was given the opportunity to asked questions.
A written response letting Licensing know how the coded items on this report must be received on or before February 23, 2018.
