Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection of the physical facility the following was observed:
- 6 cement pillars supporting the balcony of the facility had sharp and rough corners/edges presenting a hazard to young children. This item has been identified in the inspection dated February 24, 2022, Inspection #ONIR-CBXW3K. Manager stated that she is looking into addressing the issue. This is a repeat contravention.
- a 4x4 plank that is separating the sand play space from the cement area was moving presenting a hazard to young children. During the inspection children were observed trying to balance on the plank and the plank was observed moving causing a fall hazard to young children.
- around the perimeter of the facility (at the back of the facility, on Stewardson Street), on what appears to be the city lot, there is a field covered in blackberry bushes and morning glory. The plants often invade the chainlink fence of the facility causing a hazard to young children and staff. Manager stated that staff often trim the blackberry bushes and the morning glory. The blackberry bushes and morning glory must be maintained regularly to prevent injury to young children and staff.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: During the routine inspection,the manager was unable to provide evidence of the fire drill. This item was identified November 12, 2019, inspection #MPEE-BHVUWU. This is a repeat contravention.
Corrective Action(s): Please ensure fire drills are implemented at least once a month.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: During the routine inspection the manager could not produce evidence of emergency plan being conducted annually. This item has been identified in the inspection dated November 12, 2019, inspection #MPEE-BHVUWU. This is a repeat contravention.
Corrective Action(s): Please ensure the emergency plan is conducted annually.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: During the inspection licensing observed that some food in the emergency supplies bin was expired.
Corrective Action(s): Please ensure you have enough supplies to prepare, mitigate, respond and recover from any emergency.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During the inspection a random selection of children files were reviewed and 15 children's files were missing proof of immunization record. The manager stated that they are presently moving towards a hybrid format (paper and on-line) for children and staff files and that some information might not be available on paper forms.
This is a repeat contravention from November 12, 2019, Inspection #MPEE-BHUWU.
Corrective Action(s): Please ensure all children's files are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: During the inspection a random selection of children's files were reviewed for compliance and 2 children's files were missing a doctor's name and phone number. This is a repeat contravention from November 12, 2019, inspection #MPEE-BHVUWU and October 20, 2020, inspection #MPEE-BULQX3.
Corrective Action(s): Please ensure all children's files are completed.

Comments

At the inspection dated July 12, 2022 there were 29 children, 6 staff, 1 manager and an ECE student observing the program present. At this inspection the above noted contraventions were identified. Actions required by the licensee and actions required the LO included here. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
· Promoting Active Play in the program
· A conversation was had with the manager regarding the staff files. This conversation was noted previously in the inspection from February 24, 2022 inspection #ONIR-CBXW3K. The manager stated that they are slowly transitioning to a hybrid format (paper and on-line) for all facility files.
· A conversation was had with the manager regarding Policies and Procedures and updating them and making them relevant to the current practice as well as available to staff and licensing in a paper format. This discussion was noted previously in the inspection from November 12, 2019 inspection #MPEE-BHVUWU.
· A conversation was had with the manager and staff regarding maintaining accurate attendance records for all classroom and all children in attendance.
· Active Supervision
· Lead in the Water
