Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were reviewed for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: It was observed that the toilet and areas surrounding it are in need of cleaning. Licensee stated she will continue to clean the bathroom on a regular basis. The home also carries an odour of smoke. Licensee stated that nobody in the home smokes so it may be coming from the neighbours. She will look for ways to reduce the odour.
Corrective Action(s): Please ensure all areas are healthy and safe for children at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: It was observed that the fences on both side of the backyard were in disrepair with rotting wood, wobbly boards and with some screws and nails protruding. Licensee fixed many of the screws and nails on site and will remove the rest today. Licensee stated that there is a plan to fix the fence in early July

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: It was observed that no criminal record check is on file for the person who is employed as a helper. Licensee stated that this person had a previous criminal record check from another childcare program but this has expired. A new CRC has been applied for and Licensee will follow up with the criminal records review board to find out why it has been delayed. Licensee understands that this employee cannot work alone with the children until the current criminal record check arrives.
It was also observed that a relative living in the residence does not have a criminal record check. Licensee stated this has been applied for but has not arrived. Licensee will follow up with the criminal records review board to find out why it has been delayed. Licensee stated this person will not be on site during the operation of daycare hours.
Corrective Action(s): Please ensure all staff and persons living in the residence has a current criminal records check from the Criminal records review board in Victoria.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: It was observed that the person who works as a helper does not have references, which have also been checked, on file.
Corrective Action(s): Please ensure that any person working in the program has character references on file

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: It was observed that the helper who the Licensee employs does not have a resume on file.
Corrective Action(s): Please ensure any person working in the program has a record of work history on file.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: It was observed that the person helping on occasion in the daycare is missing evidence of any training and skills.
Corrective Action(s): Please ensure any person employed has evidence of training and skills on file.

Comments

Summary of Inspection
At the inspection dated June 21, 2019 there were 5 children and 1 staff present. At this inspection the above noted contraventions were identified.
Actions required by the Licensee:
Take corrective action by bringing facility into compliance
Provide a written response to Licensing

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy provided.
The following education topics were discussed:
· Active Supervision
· Lead in the Water
· Bill 5 information
· Reportable incidents
A discussion was had about a child who will be over 12 attending for the rest of the school year. A retention can be applied for and Licensing will forward this application form to the Licensee by email if Licensee choose to apply. In future a criminal record check could be obtained for a 12 year old to work in the program as a volunteer if Licensee chooses.
Licensee was unaware that a repayment agreement would be required to give to each family as listed in section 19 in the Community Care and Assisted Living Act and in section 56.1 (2) (a) & (b) in the Child Care Licensing Regulations. The Licensing officer will forward some information as a resource to assist Licensee to create this agreement.
