Introduction

An unscheduled routine inspection of this community care facility (CCF) was conducted by the licensing officer (FHA) to assess compliance w/ the:
• Community Care & Assisted Living Act (CCALA)
• Child Care Licensing Regulation (CCLR)
• Director of Licensing Standards of Practice (DLSP; Active Play & Safe Play Space)

At the time of inspection, evidence for this facility inspection report (FIR) was based upon:
• FHA's observations
• FHA's review of the CCF's records
• information provided to FHA by employees

FHA reviewed these 10 areas today:
• licensing • hygiene & communicable disease control
• physical facility • medication
• staffing • nutrition & food services
• policies & procedures • program
• care & supervision • records & reporting

As part of this inspection, FHA completed & provided a risk assessment tool, which includes:
• any noncompliance identified • the CCF's compliance & operational history since 05/Jun/2015

Contraventions
Previous Inspection - Contraventions observed on FIR #CGEE-ALJP7N have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation (CORRECTED DURING INSPECTION): The gate wasn't securely closed when children began utilizing the outdoor play space.
Corrective Action(s): The licensee blocked the entrance w/ a small picnic table.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): 2 electrical outlets weren't covered in the nap room.
Corrective Action(s): The licensee installed 2 outlet covers.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11290 - DLSOP Safe Play Space (play space design [b4]) - [bullet 4] For prevention of entrapment, spaces (i.e., holes or openings) must be smaller than 9 cm (3.5 inches) or larger than 23cm (9 inches).
Observation: A fence picket has fallen out of place; therefore, there's a 5-6" opening.
Corrective Action(s): The licensee must ensure that there aren't any entrapment hazards in the outdoor play space.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: An employee lacked a reference.
Corrective Action(s): The licensee must ensure that 3 references are obtained by employees' 1st day of employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation (CORRECTED DURING INSPECTION): An employee's ECEA certificate hasn't been validated by the licensee.
Corrective Action(s): The licensee validated her employee's ECEA certificate & her own ECE certificate.

STAFFING: 12470 - CCLR s.60(4) - Immediately after a person who was the subject of a character reference is no longer employed by or ordinarily present at the community care facility, a licensee must return all character references to the person, or destroy the character references.
Observation (CORRECTED DURING INSPECTION): A former employees' reference still remained in her file.
Corrective Action(s): The licensee shredded the reference.

POLICIES AND PROCEDURES: 13100 - DLSOP Active Play - The Licensee must develop and implement an Active Play Policy to engage children in daily active play, consisting of un-facilitated play and facilitated games and activities.
Observation: The licensee hasn't developed this policy yet, but she stated that she implemented it in Sep/2017.
Corrective Action(s): Please develop this policy.

POLICIES AND PROCEDURES: 13110 - DLSOP Active Play - [The Licensee must develop and implement an Active Play Policy to engage children in daily active play, consisting of un-facilitated play and facilitated games and activities.] This policy should also be shared with parents/families.
Observation: This policy hasn't been developed yet.
Corrective Action(s): The licensee should share this policy w/ parents/families.

POLICIES AND PROCEDURES: 13120 - DLSOP Active Play - The Licensee must develop and implement a Screen Use Policy to guide employees in the use of screen time activities.
Observation: The licensee hasn't developed this policy yet, but she stated that she implemented it in Sep/2017.

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation (CORRECTED DURING INSPECTION): FHA observed a reportable incident in the minor incident log from 31/Jan/2018 that was never reported to FHA.
Corrective Action(s): The licensee completed RIF #90157328.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): Not all children were signed in today.
Corrective Action(s): The licensee signed all children in.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation (CORRECTED DURING INSPECTION): A child whose last day of care was 31/May/2018 didn't have this documented in his file.
Corrective Action(s): The licensee added the child's last day of care to his file.
