Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). Evidence for this report was based on the licensing officer’s observations, review of the facility records, and information provided by the facility staff at the time of the inspection.

The following areas were reviewed:

· Hygiene and Communicable Disease Control
· Medication
· Nutrition and Food Services
· Program
· Records and Reporting

As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection, and a 3 year “historical” review of the facility’s compliance operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #SCHE-AMQT3H have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10010 - CCLR s.10(1) - Applicants for licences and licensees must notify a medical health officer immediately of any change in the information provided under section 9.
Observation: Licensing notes that the manager did not notify licensing of the following changes:
- The approved outdoor play area is currently blocked off due to renovations. The outdoor time has continued in another area of the neighborhood.
- The staffing plan submitted to Licensing to support a Staffing Exemption changed over a month ago.

Corrective Action(s): Please ensure that any changes of information that has been previously approved by licensing, needs to be immediately disclosed to Licensing.
To correct the two above items, please submit:
- a new play space away plan, including all of the information required in the Play Space Away Bulletin
- A new staffing plan, and potentially a new exemption request.
Date to be Corrected: May 8, 2018.

LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The manager's name was not posted.
A recently hired staff's certificate was also not posted.
Corrective Action(s): Please ensure the manager's name as well as all staff certificates are posted.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): The cupboard in the washroom which contains cleaning products was left unlocked.
Corrective Action(s): Please ensure that a system is in place to guide ensure all hazardous substances are stored out of reach of children.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: One staff's file does not have evidence that their ECE certificate has been validated.
Corrective Action(s): Please ensure staffing files are complete.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: A fire drill documentation was posted on the wall, there was no evidence of an April Drill. The manager confirmed that the April fire Drill was not conducted.
Corrective Action(s): Please ensure a monthly fire drill is practiced by all staff.
All drill must be recorded.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: The facility has been licensed since November 2016, the manager stated that they have not practiced a complete Emergency Drill yet.
There are no emergency supplies on site.
Corrective Action(s): Please ensure all staff practice implementing a complete emergency evacuation drill.
These drills must be conducted at least once a year by all staff.
Emergency supplies to recover from any emergency, must be kept on site. A sample list was provided.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: There is no evidence of Active Play or Screen Use policies on site.
Corrective Action(s): Please ensure two new policies are created as outlined in the Director of Licensing Standards of Practice- Active Play

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: The licensed Group Child Care (30 months to School Aged) program was staffed today with an ECE and an RA.
This is the regular staff at the facility, since end of March.
Corrective Action(s): Please ensure staffing requirements of Schedule E are maintained.

Comments

During today’s inspection the Licensee, one staff and 15 children were on site. Licensing observed the following:
- Children were working on Mother's Day Activities as well as doing Montessori work
- Staff are very attentive to the needs of the children, getting down to their level, using clear concise requests to guide their behaviour and providing many activities to support the age and development of each child.

Reviewed and/or Discussed at time of this inspection with the Licensee:
· Updating attendance for clarity - ensure this document is used in the moment- children signed in when they arrive and out when they leave. As well as documenting absents.
· Discussed the use of the word preschool (as this was the past Licence)
· Ensuring staff with expired first aid certification are not left alone with children.
· Parent Handbook /Policies and Procedures should be on site to guide staff
· Washroom- not for Public Use, create policy to guide staff
· Licensing suggests putting the date (on the current CRC) that the sharing information was submitted

· Fire Drills

Please provide a written response by May 15, 2018 addressing the above cited contraventions.
Due to the nature and number of contraventions a follow up inspection will be conducted in the near future.
This inspection was reviewed with the Licensee prior to signing.
