Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Plastic bags were stored by the sink that are accessible to children. The bedding sheets used by children were all stacked together in the closet promoting cross contamination There were many toys i.e puzzle pieces,blocks,playing cards and other toys on the floor which are a tripping hazard. During the inspection a child ran and slipped on piece of plastic food and hit his head on the floor.
Corrective Action(s): Please ensure that a safe environment is provided at all times while children are under the supervision of employees.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Overall level of cleanliness and organization of the materials in the facility requires attention.
Corrective Action(s): Ensure a system is developed and implemented by where the premise is maintained/cleaned regularly to promote children's health. Please email licensing a plan to maintain compliance. This is a Repeat Contravention DCAR-BY5NGJ

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed open garbage bag and open ice melt bag at the entrance to the facility. Dog feces were observed throughout the children’s’ outdoor play area. Also noted large rocks,plastic debris and pile of wet leaves in the play area. Upon inspecting the indoor area it was observed that the plastic bags,brooms,mop were stored by the sink that are easily accessible to children.
Corrective Action(s): Ensure that children do not have access to items which present risk to their health and safety. The dog feces have been an ongoing issue which requires a permanent solution. This is a Repeat Contravention DCAR-BY5NGJ.
Please submit a plan to ensure that children's outdoor play area is free of hazards on a regular and ongoing basis.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: At the time of inspection minimum of two character references were not included in the file.
Corrective Action(s): Ensure that two character references are included in the employees file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: At the time of inspection the ECE certificate verification was not included in the employees file.
Corrective Action(s): Ensure that ECE certificate validation is included in the employees file.

STAFFING: 12180 - CCLR s.22(2)(a) - A licensee must ensure that each employee (a) is trained in the implementation of the fire drill system and emergency plan described in subsection (1), including the use of any equipment noted in the fire drill system and emergency plan.
Observation: The service tag for the fire extinguisher was missing.
Corrective Action(s): Ensure that the fire extinguisher is serviced annually and the service tag is attached to the extinguisher.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: Annual Emergency Evacuation plan/drill record was not available for licensing.
Corrective Action(s): Ensure that emergency evacuation drill is implemented and recorded annually.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The food and the water in the emergency supplies kit was expired.
Corrective Action(s): Licensee to ensure that emergency supplies are checked yearly to mitigate and recover from an emergency.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Medical practitioner phone number was missing from one out of five child's files checked
Corrective Action(s): Ensure that the children's files and records are maintained and available in single place

Comments

At the inspection dated January 21, 2022 there were 5 children and licensee present. At this inspection above noted contraventions were identified. Written action plan required to include plans for ensuring children outdoor play area is clean and safe for children to use. Follow up inspection to occur due to ongoing contraventions related to use of yard and cleanliness of facility.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided. Business card was provided.
