Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed that the white gate outdoors at the front of the property is broken
Corrective Action(s): Ensure that this item is fixed for the safety of children

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing observed that four staff either did not have a CRC record on file or the CRC was not from the CRC Review Board under the facility's name.
Corrective Action(s): Ensure that all CRCs are from the Criminal Records Review Board under the name of the facility. All staff must have a CRC on file available at the facility.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation (CORRECTED DURING INSPECTION): A record of the person's work history was not obtained for one or more employees.
Corrective Action(s): Ensure that each staff's resume/work history documentation is on file

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): Immunization status was not obtained for one staff.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): Licensing observed that four staff did not have a validation on file
Corrective Action(s): Ensure that certificates are always validated online

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation (CORRECTED DURING INSPECTION): A criminal record check was not obtained for one practicum student
Corrective Action(s): Ensure that the file is always complete with the CRC for practicum students

STAFFING: 12152 - CCLR s.19(5)(b) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (b) character references in respect of the person.
Observation (CORRECTED DURING INSPECTION): A minimum of two character references were not obtained for one practicum student

STAFFING: 12153 - CCLR s.19(5)(c) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (c) evidence that the person has complied with the Province's immunization and tuberculosis control programs.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that the fire extinguisher had a service due date of Nov. 29, 2023.
Corrective Action(s): Ensure that the extinguishers are serviced and that a new tag is placed

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation (CORRECTED DURING INSPECTION): Licensing observed that two children did not have the start date written on file
Corrective Action(s): This was corrected by the manager during the inspection

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed the following:
- The facility is not indicating on the attendance record if children are absent
- Two children today were not signed in
Corrective Action(s): Ensure to clearly record if children are absent, and indicate the time that they arrive on the attendance record daily

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing observed one child had no emergency contacts on file
Corrective Action(s): Ensure that the child's file is complete

Comments

*This is the first routine inspection of the facility since being licensed.

At the inspection dated Feb. 15, 2024 there were 30 children, 4 staff present and 3 practicum students.The manager also arrived on-site and assisted with the inspection. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the facility manager during the inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following recommendations/discussions were provided:
- Reportable Incident procedures, which is to be reported within 24 hours. Child care staff are asked to call their Licensing Officer to make the report. If the Licensing Officer is unavailable, please call and speak with the Duty Line Licensing Officer.
- Continue to document minor incidents using the incident log bound book, and take note of any illness and unexpected events involving children not requiring medical attention, and that are not reportable incidents as described in Schedule H. Staff are to continue to initial and write the date after each documentation.
- Continue to constantly review facility policies
- Continue to clean and sanitize the facility including toys and equipment
- Check the expiry date of items in the emergency supplies kit
- Spacing of water bottles when not in use
- Serving of food and temperature
- Continue daily outdoor play with children
- Continue to review policies with staff, practicum students etc.
- Procedure for fire and emergency drills
- Constant meetings with all staff, manager, licensee and everyone involved to discuss practice, organization of files and documentation etc pertaining to the facility.
