Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12370 - CCLR s.37(3)(b) - Despite the employee qualifications required by Column 4 of the table in section 1 of Schedule E [group sizes and employee to children ratios], a licensee must replace an absent employee described in Column 1 of the following table who is absent (b) for 30 consecutive days or more with a person described in Column 3 opposite that employee and the row in Column 2 labelled as "≥ 30 days".
Observation: The facility manager has been absent since February 13, 2020 and no replacement manager has been approved.
Corrective Action(s): A person qualified to be a manger must be appointed and notice given to the Licensing Officer if the manager is away from the facility for more than 30 consecutive days.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: There are not enough emergency supplies for all of the children for up to 72 hours and there are no foods in the emergency supplies that are suitable for children who have dietary restrictions. This item was noted on Routine Inspection #WBET-BDWQEX dated July 9, 2019.
Corrective Action(s): Appropriate emergency supplies for all children need to be available at the facility.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Emergency contact information for one child is not available.
Corrective Action(s): Please ensure that all children's files have information for an emergency contact person.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: Files for 16 children were reviewed. Care plans were not available for 6 children. This was discussed with the Licensee Contact during Routine Inspection #WBET-BDWQEX dated July 9, 2019.
Corrective Action(s): A plan that gives staff instructions on actions that need to be taken needs to be available for all children requiring extra support.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: A care plan for a child with additional needs has not been reviewed in the past 12 months.
Corrective Action(s): Please ensure all care plans are reviewed at least once every 12 months.

Comments

Summary of Inspection
At the inspection dated July 22, 2020 there were 15 children and 2 staff present. At this inspection the above noted contraventions were identified. The Licensee is required to submit a written response to the Licensing Officer. The Licensing Officer will review the written response and conduct a follow up inspection to ensure compliance. As part of this routine inspection a facility risk assessment tool is completed and a copy is provided. a copy of this inspection report and the facility risk assessment tool was sent to the Licensee by email on July 23, 2020.
The following were discussed with the Licensee Contact:
A responsible adult has been working in place of an ECE Assistant. This is allowable for 30 consecutive days. The last day the responsible adult can replace the ECE Assistant is July 24, 2020.
Permission from parents must be obtained before staff use Vaseline Skin Therapy cream on children.
Children will be walked to and from Kindergarten when school resumes. It is important that the transportation policy be reviewed staff with and that all staff can follow the policy prior to them taking children to and from school.
Adjusting the daily schedule to meet the needs of the children. For example if the children's energy is high have a period of outdoor play.
