Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), The Child Care Licensing Regulation (CCLR) and the Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Licensing observed 3 staff certificates were not posted.
Corrective Action(s): Please ensure a system is in place to replace or post certificates when staffing changes are made.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following in the outdoor play area:
-An outdoor kitchen abutted the fence. This is a repeat contravention from inspection #CLAN-CP3RSL. A step drop off to a stairwell was located on the other side of the fence.
-The landscape fabric in the play area was showing. This could cause a potential tripping hazard.
-A playground check was not completed for the day prior to the children entering the play area.
Corrective Action(s): Please ensure there is a system in place to regularly monitor the outdoor play area to ensure a healthy and safe environment.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: Licensing observed multiple items partially blocking the emergency exit.
Corrective Action(s): Please ensure to store items that are partially blocking exits to ensure a safe evacuation in case of emergency.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed plastic bags for diapers at the children's level and 2 loose plastic bags in the staff washroom
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to their health and safety.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: In discussion with staff they stated they did not complete an annual emergency plan
Corrective Action(s): Please ensure to complete the emergency plan on an annual basis and to document the date of completion.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: A criminal record check is not current (expired) for the Manager.
Corrective Action(s): Please ensure to complete criminal record checks prior to the expiry date.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: The children's records were reviewed. Many records were missing photos. This is a repeat contravention from inspection #CLAN-CP3RSL

Comments

At the inspection dated February 26, 2024 there were 25 children, 11 staff, one student and the Manager arrived during the inspection. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by March 11, 2024 unless otherwise specified in the report. As part of the inspection the Facility Risk Assessment Tool is completed and a copy was provided to the Manager.

The following was discussed with the Manager:

-Reportable incident reporting
-Lead in the water prevention strategies
-The cleaning protocols that are in place for the facility
-Submitting an outdoor play plan for the 30 months to school age classroom
-Diapers are required for the emergency kit.

The following will be sent to the Manager:
-Away play space bulletin
-Temporary Placement/Retention Information
