Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The Manager's name was not posted in a prominent place.
Corrective Action(s): Please ensure the Manager's name is posted in a prominent place in the facility.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: One staff file did not have character references available.
Corrective Action(s): Please ensure that staff files are complete.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for one staff.
Corrective Action(s): Please ensure staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): Immunization status was not obtained for one staff. Licensing provided the FH Immunization Declaration form for staff to complete.
Corrective Action(s): Please ensure staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: ECEA certificate validation was not obtained for one staff file.
Corrective Action(s): Please ensure staff files are complete.

Comments

At this inspection there were 6 children and 2 staff present. At this inspection, the above contraventions were identified. The Manager will send Licensing a written response addressing the contraventions by June 22, 2023 and Licensing will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following was discussed/reviewed with staff:
- Required documents in staff files
- A deflated bouncy castle was observed in the outdoor play area. Discussion was had regarding following the manufacturer's instructions regarding recommended age and number of children allowed at a time. Licensing recommends that the Manager create a policy regarding the safe use of this equipment.
- Ensuring children are actively supervised at all times in all areas of the daycare
- Full-time staff must have ECE certificates prominently displayed
- Securing the fence in the outdoor play area and closing off any gaps
- Staff may sign in/out the child on the attendance sheet
- The importance of having physical copies of children's photos on the emergency cards in the event of an emergency
