Introduction

All care categories were inspected during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act (CCALA)
• the Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practices (DLSP)

Contraventions
Previous Inspection - Contraventions observed on FIR #CGEE-C3KTUK have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: CCFL reviewed all employees' files. An employee's recently-expired CRC is addressed to another organization. The corporation director stated that he applied for this employee's CRC 3 months ago & hasn't received anything; therefore, he'll follow-up w/ the BC Ministry of Justice's Criminial Records Review Program immediately.
Corrective Action(s): All requirements of s. 19 are required by employees' 1st day of employment. This employee can't work alone w/ children or assist w/ diapering/toileting until her CRC has arrived.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): There was no evidence that the manager's ECE certificate was verified.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation (CORRECTED DURING INSPECTION): CCFL reviewed all children's files & found that several start dates only stated the month & year.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation: Former children's last day of care wasn't documented.
Corrective Action(s): Children's last day of care must be documented.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: A care plan for a child requiring extra support was last signed/dated by her parent in 2019.
Corrective Action(s): Care plans must be reviewed/signed/dated annually w/ parents to discuss any changes in their child's extra support needs.

Summary of FIR #CGEE-CD7QKP (05/Apr/2022)

5 violations were observed today, in which 2 violations were corrected today & corrective action for the remaining 3 violations includes obtaining employee & children documentation.

CCFL discussed key points from the BCCDC's "Public Health Guidance for Child Care Settings" (http://www.bccdc.ca/Health-Info-Site/Documents/COVID_public_guidance/Guidance_Child_Care.pdf).

CCFL reviewed the inspection w/ the manager; however, this report & the facility risk assessment were completed @ the Burnaby Health Protection office & emailed to the manager on 05/Apr/2022.
