Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Contraventions
Previous Inspection - Contraventions observed on FIR #ANAI-BNHNJG have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Building directly behind the daycare and the infant toddler play space is currently under renovation. Manager stated that the Infant Toddler program has not been going outside as it is unsafe. On multiple occasions the facility has found small pieces of metal from the construction. When Licensing conducted the inspection, 3 small pieces of metal (nails, screws, etc) were found while inspecting the play space. Manager indicated that they were told that the construction was going to last a few months and no warning was given in regard to the renovation starting. A discussion was had with the Manager about the Infant toddler program using the Group Child Care (3-5) play space for the next few months while the building is undergoing exterior renovation. Should the construction be longer than a few months, safety measures will need to be put in place in order to mitigate the hazards noted within the infant toddler program in order for the program to be able to safely use their designated outdoor play space. Prior to the infant toddler program using this play space, please address the following:
-Old toys in disrepair (i.e. missing seats, broken pieces)
-Areas of plastic that was installed at the bottom half of the fence is broken in places and can be rough to the touch.

Please also remove any toys that are in disrepair within the GCC 3-5 play space.

Licensing also noted that in the afternoon within the both play spaces, there is minimal shade. Manager stated that they tend to only go out in the morning when there is shade. As the program is now required to have 3 service types share one play space as a temporary measure, some groups may need to come out in the afternoon when there is minimal shade. Please ensure that there is shade available.

Corrective Action(s): Please ensure a healthy and safe environment. Please also submit a play schedule which allows for all service types to use the GCC 3-5 program while the renovations are underway next door.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The following were noted at today's inspection:
-Some areas which require some additional cleaning (walls near the bathroom, light switches in washroom)
- Peeling paint on the walls in various locations
Corrective Action(s): Please ensure facility is clean and in good repair.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Upon review of staff files, Licensing noted that three staff did not have site specific criminal record checks.
Corrective Action(s): Please ensure staff files are complete

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Upon review of staff files, Licensing observed that one staff had references noted but no notation to indicate that they have been verified.
Corrective Action(s): Please ensure staff files are complete.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Upon review of the staff files, Licensing noted that one staff was missing a resume.
Corrective Action(s): Please ensure staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Upon review of staff files, Licensing noted that 2 staff were missing immunization information
Corrective Action(s): Please ensure staff files are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing noted that at times, children from one service type are moved into another service type and this is not indicated on the attendance, making it inaccurate and difficult to follow. Discussion had with Manager about ensuring that children are signed in and out of the rooms when they are moved.
Corrective Action(s): Please ensure attendance is accurate

Comments

At the inspection dated June 1, 2021, there were 14 children and 4 staff present.
At this inspection, the above noted contraventions were identified
Actions required by the licensee - Please submit a written response to indicate how you will address the contraventions noted above on or before June 9, 2021.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed.

The following education was provided:
-Discussion in regard to ensuring the staff to child ratio is met at all times. Should an IT staff not be on site when a child arrives for care, child cannot be in this room with a staff with less credentials.
-In future, please keep Licensing updated should you not be able to use your facility as intended (i.e. outdoor play space not usable due to construction next door).

The following recommendations were provided:
-Organizing staff files so that it is easier to confirm they are complete.
-Second emergency location, as first location is located a few doors down.
-COVID-19 strategies discussed
