Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act, Child Care Licensing Regulation and the applicable Director of Licensing Standards of Practice. All areas of the facility were inspected for compliance except for the facility's policies and procedures as these were reviewed at the time the licence was issued - April 24, 2019. On the first day of this multi-day inspection the Licensing Officer was accompanied by a Justice Institute of BC student.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation (CORRECTED DURING INSPECTION): During the inspection the Licensing Officer noted in some of the program rooms staff have posted their applicable certificates.
Corrective Action(s): In discussion with the Manager she is aware that all staff must post a copy of their certificate in a prominent place however some staff have been hired recently and have yet to post their certificates.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing staff observed: 1) three large containers of bleach stored beside the facility's washer and dryer which is located across the hallway from the kitchen; 2) cords from baby monitors located in various nap rooms and one was noted to be beneath a child's bedding; 3) staff personal belongings on the floor of the storage rooms located within the classrooms.
Corrective Action(s): In discussion with the Manager the containers of bleach were immediately relocated to a locked janitorial closet. Licensing acknowledges that the bleach was observed in an area not usually accessed by the children however there is the potential that children could access the items which poses a serious hazard. The Manager indicated that she was aware of the cords and a discussion occurred as to various ways to ensure the cords are secured and/or made inaccessible to the children as there is the potential risk of choking or electrocution. In previous discussions with the Licensee the storage rooms in the classrooms were intended for storage of equipment and supplies for the program and for staff to store their personal belongings. The Licensee indicated that shelves and/or coat hooks would be installed. Staff leaving their belongings on the floor leaves the items accessible to the children. The Licensee will need to work with staff to ensure their belongings are not accessible to children.

STAFFING: 12100 - CCLR s.19(2)(a) - A licensee must not employ a person in a community care facility unless the licensee is satisfied, based on the information available to the licensee under subsection (1) and the licensee's or, in the case of an employee who is not the manager, the manager's own observations on meeting the person, that the person (a) is of good character.
Observation: Licensing reviewed 9 staff files and noted that all but one file had evidence that the references were validated. One file contained references that were not related to the individual working with children however the file did contain an application to the ECE Registrar for a early childhood education certificate and there were 2 references for this purpose.
Corrective Action(s): The Licensee must ensure that staff's references are verified and that the references are related to working with children. This documentation must be completed and on file prior to the individual working with children.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Licensing staff reviewed 9 staff files and 3 files contained criminal record clearance letters addressed to another employer or agency. Some of the files did contain information indicating that the Licensee had applied to have the results shared with them.
Corrective Action(s): The Licensee must ensure that anyone regularly on site and over the age of 12 years have a current criminal record clearance letter addressed to the Licensee on site prior to the individual caring for children.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing staff reviewed 18 children's files, pulled at random, and noted that 7 files were missing the child's immunization status.
Corrective Action(s): A discussion occurred with the Manager that families do not need to produce a list of their child's immunizations. The child's immunization status is all that is required.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing reviewed 18 children's files, pulled at random, and noted that 2 of the files did not contain the child's medical practitioner.
Corrective Action(s): Licensing discussed with the Manager if a family does not have a medical practitioner than the name of a clinic used by the family would suffice or alternately the family can write in 'none' for this section and the Manager could touch base with the family in a few months to see if the status has changed.

Comments

At the inspection dated October 21, 2019 there were 15 staff and 41 children present. At this inspection the above noted violations were identified and the actions required by the staff are included. As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided.

During the inspection licensing inspected the outdoor play area and observed 2 staff and 7 children outside with 1 soccer ball. In discussion with the Facility Manager licensing was informed that as a part of the facility's curriculum staff teach the children how to use the equipment for the intended use such as basketball, soccer etc. The activity is presented to the children and then the children have an opportunity to practice what they have been shown. Following this staff will bring out other outdoor activities. After each program is finished using the outdoor play space staff put all equipment away in the onsite shed leaving the outdoor space free of equipment and supplies.

This inspection report was written up at the licensing office and the time spent writing the report is not reflected in the 'time spent' box.
