Introduction

All care categories were inspected during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act (CCALA)
• the Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practices (DLSP)

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: *Repeat violation of FIR #SMOY-BZKU8U (29/Mar/2021)*
1) Some interior walls had chips & spots w/ worn paint, which are porous & uncleanable.
2) The rubber ramp cover (outside) was peeling on 1 side, which is a tripping hazard.
Corrective Action(s): The manager stated that:
1) These areas can be repaired within a few weeks.
2) She'll speak to the building manager re. repairs.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: *Repeat violation of SMOY-AXAR9U (28/Mar/2018), SMOY-BL529G (23/Jan/2020), & SMOY-BZKU8U (29/Mar/2021)*
CCFL reviewed all employees' files. 3 employees lacked CRCs & 1 employee's CRC was addressed to another organization.
Corrective Action(s): All requirements of s. 19(1) must be obtained by employees' 1st day of employment, which includes CRCs & CRC shares. The manager showed CCFL evidence of her recent CRC applications for these 4 employees. In the meantime, these employees can't work alone w/ children or assist w/ toileting/diapering.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: An ordinarily present individual lacked a CRC.
Corrective Action(s): The manager showed CCFL that she recently applied for this individual's CRC.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: CCFL reviewed all employees' files. 1 employee lacked references. The manager explained that 2-3 references were checked for this employee, but the employee took the documentation afterwards.
Corrective Action(s): All requirements of s. 19(1) must be kept onsite @ all times.

POLICIES AND PROCEDURES: 13010 - CCLR s.22(1)(a) - A licensee must (a) ensure that a community care facility has (i) emergency exits that meet the requirements of the BC Building Code, and (ii) a fire drill system that is approved as definedby section 31 of the Fire Services Act.
Observation: Fire extinguishers were last serviced in 2020/Aug.
Corrective Action(s): Fire extinguishers require annual servicing, by the date indicated on the service tag.

RECORDS AND REPORTING: 19010 - CCLR s.55(1)(a)(1.1) - A licensee must immediately notify a parent or emergency contact if, while under the care or supervision of the licensee, the child (a) becomes ill or is injured.(1.1) In the case of a licensee who provides a care program described as Child-minding, the parent to be notified under subsection (1) is the parent who is on the premises on which the child-minding service operates.
Observation: Based upon discussions w/ the manager, parents aren't always notified immediately when children become injured, unless it appears more serious, &/or blood is present.
Corrective Action(s): Parents or emergency contacts must be notified immediately when children becomes ill or injured, so they have the opportunity to pick-up their child ASAP, if they wish.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: Care plans for children requiring extra support were unavailable.
Corrective Action(s): Care plans must be created in consultation w/ parents, & posted in the children's program rooms.

Summary of FIR #CGEE-CD3N8E (30/Mar/2022)

7 violations were observed today, in which corrective action includes:
• addressing physical hazards
• obtaining employee documentation
• obtaining servicing for fire extinguishers
• obtaining children documentation

CCFL discussed key points from the BCCDC's "Public Health Guidance for Child Care Settings" (http://www.bccdc.ca/Health-Info-Site/Documents/COVID_public_guidance/Guidance_Child_Care.pdf).

CCFL reviewed the inspection w/ the manager; however, this report & the facility risk assessment were completed @ the Burnaby Health Protection office & emailed to the manager on 01/Apr/2022.
