Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Contraventions

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following:
- One tall shelf in the nap room that is wobbly and not secured to the wall.
- At the doorway of one of the play rooms, a bushy patch of fuzz/thread like material coming out of the carpet. The Licensee cut the patch off.
Corrective Action(s): Please ensure that the furniture, equipment and fixtures within the care facility are clean and in good repair.
Date to be Corrected: January 24, 2020.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Upon a review of three staff records Licensing observed that one staff's record missing validation of their certificate.
Corrective Action(s): Please ensure that all staff files are complete.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): Licensing observed, through a discussion with the Licensee, that there is a child that attended the care facility starting in December 2019 that had not turned 36 months. The Licensee had four children in care under the age of 36 months. Under schedule E the type of service being provided there can be no more than three children under 36 months.
Licensing provided education on the intent of the regulation.
This is a repeat contravention.
Corrective Action(s): Please ensure that children attending the care facility are divided into groups with each group having no more children than that is permitted in Schedule E.
Date to be Corrected: January 22, 2020.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Upon a random review of five out of eight children's records Licensing observed one child's record missing the date of enrollment.
Corrective Action(s): Please ensure that all children records are complete prior to the child attending the care facility.
Date to be Corrected: January 24, 2020.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Upon a random review of four out of eight children's records Licensing observed the following:
- One child missing an emergency contact.
- One child missing the medical practitioners name and phone number.
Corrective Action(s): Please ensure that all children records are complete prior to the child attending the care facility.

Comments

Summary of Inspection
At the routine inspection conducted today, January 22, 2020, there were 6 children and 1 staff present. The Licensee arrived at the facility while Licensing was conducting the inspection. At this inspection the above noted contraventions were identified. The Licensee is required to correct all identified non-compliances by the dates indicated above in the violations section. A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
