Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were reviewed for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation (CORRECTED DURING INSPECTION): The folowing was observed in disrepair:
-outside, the step from the back deck to the yard was loose
outside, the gate from the back deck to the yard had a sharp edge with reach of the children
The following was observed that needed cleaning:
-diaper change mat had dirt and dust in the corner and edges
Corrective Action(s): Please ensure that all furniture, equipment and fixtures are clean and in good repair

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Licensing observed the following:
- 2 medicated diaper creams were stored in unlocked drawers by the change table, accessible to children
-bleach and water solution was stored on top of low drawers by the change table, accessible to children
-a spray in an air wick bottle was stored on the edge of kitchen island counter accessible to children. Manager stated that the bottle had Lysol in it. Manger agreed to label or store solutions in original bottle.
All were moved out of reach of children immediately, while on site.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Four staff files were reviewed. One staff held one previously and now has an expired Criminal record check. The manager stated that this was noted and the new CRC was applied for on June 3, 2019. Manager will ensure that this staff does not work alone with the children until the new CRC is issued.
Corrective Action(s): Please ensure all staff have a valid Criminal record check through the criminal records review in Victoria.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Four staff files were reviewed. One staff member has an expired Early Childhood Education certificate. The certificate was applied for 2 weeks before it expired and the manager has called the ECE registry multiple times to follow up on when the certificate will arrive.
Corrective Action(s): Please ensure all staff have valid certification on file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Four staff files were reviewed and one staff was missing immunization status.
Corrective Action(s): Ensure all staff have complied with the Province's immunization control program.
Date to be Corrected: June 21, 2019.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation (CORRECTED DURING INSPECTION): Four children's records were reviewed and one file was missing the MSP (care card) number. Manager contacted parent and the number was recorded while on site.
Corrective Action(s): Please ensure all children have an MSP (care card) number recorded.

Comments

Summary of Inspection
At the inspection dated June 14, 2019 there were 7 children and 2 staff present. At this inspection the above noted contraventions were identified.
Actions required by the Licensee:
Take corrective action by bringing facility into compliance

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy provided.
