Introduction

An unscheduled follow-up inspection to routine inspection #MPEE-CKMP4N was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP).

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the manager was not posted. This is noted to be a repeat contravention.
Corrective Action(s): Ensure the name of the manager is posted in a prominent place in the facility.
Date to be Corrected: March 22, 2023

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: A staff certificate was not posted. This is noted to be a repeat contravention.
Corrective Action(s): Ensure staff who hold an educator or assistant certificate have their certificate posted in a prominent place.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed 2 staff files. Out of the 2 reviewed, 1 file did not have a criminal record check. There was evidence an application was submitted, however no dates indicating when. This is noted to be a repeat contravention.
Corrective Action(s): Ensure a current and valid criminal record check has been obtained.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 2 staff files. Both files contained references however, the references were not checked to ensure the individual is of good character. This is noted to be a repeat contravention.
Corrective Action(s): Ensure character references in respect to the staff has been obtained and checked to ensure the individual is of good character.

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: Licensing observed a 16 year old working in the school age program. While the facility complied with staff to child ratio, the staff was not of age or qualified to work in the program.
Corrective Action(s): Ensure children are adequately supervised by qualified employees.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing noted the following:
- No attendance recorded on March 6 and 8.
- No indication whether children were absent or present March 13, 14 and 15.
Corrective Action(s): Ensure there is an accurate daily attendance record indicating for each day whether the child is absent, or if the child is present, the time or arrival and departure.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Licensing reviewed a child's record. The care plan within the file was last created and reviewed in 2020. This is noted to be a repeat contravention.
Corrective Action(s): Ensure care plans are reviewed once each year with the parent of the child requiring extra support and any person requested by the parent.

Comments

Summary of Inspection:
At the inspection dated March 15, 2023 there were 5 children in care with 2 staff.
Licensing received a written response from the Manager addressing the contraventions from the routine inspection. The follow- up inspection was an opportunity to ensure all the coded violations have been addressed. All coded violations from the routine inspection have not been addressed, see contraventions above.

The following discussions were had:
Licensing noted good documentation in the minor incident log book. A discussion was had with the staff to include the 5 W's when documenting (who, what, where, when, why and how)
