Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with the exception of the policies and emergency supplies.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed inside the facility:
-One bottle of bleach and water was being used for the change table and the classroom. This could cause a potential for cross contamination.
-Three plug covers were missing. This is a repeat contravention from inspection # CLAN-BJDQ9X, and #CLAN-BRKPMQ
The following was observed in the outdoor play area:
-Two adult bikes and one older children's bike was located in the outdoor play area.
-An uncoiled water hose was observed. This is a repeat contravention from inspection # CLAN-BRKPMQ
-A gate to a seperate area was open. A trampoline with rust was observed inside.
-A car seat was placed on top of a bench and a cooler. This could present a potential falling hazard
-The climber (taller than 18') was placed close to a surface that was not resilient. This was corrected during the inspection. This is a repeat contravention from inspection #SSAU-C69S2K.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times to the children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed that the diaper changing mat was ripped in two places and the foam was exposed.
Corrective Action(s): Please ensure that the equipment in the facility is in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: During the inspection the following was observed inside the facility:
-A window limiter was not applied to windows located in the sleep room and the main room. The windows are located on the second floor. The windows were open and only a screen was attached. This was at the children's level. The serious falling risk to children was discussed with the Licensee. This was corrected during the inspection. This is a repeat contravention from inspection # CLAN-BJDQ9X
-A large screen TV was placed on a low table. This could present a falling hazard. This is a repeat contravention from inspection # CLAN-BRKPMQ, .
-The washroom cupboard was unlocked, even though a lock was present on the cupboard. The cupboard contained a large bottle of bleach. This was accessible to children. This could present a potential poisoning hazard. This is a repeat contravention from inspection # CLAN-BJDQ9X.
- Bleach and water and another chemical in a spray bottle were located on the back of the toilet. This was within easy reach of the children. This could cause a potential poisoning hazard. This is a repeat contravention from inspection
# CLAN-BJDQ9X. This was corrected during the inspection.
-Hand sanitizer, Clorox wipes and a spray bottle of rubbing alcohol were located on a low shelf. This was accessible to children.

The following was observed in the outdoor play area:
-Two open bags of lump charcoal. This could be a potential poisoning hazard. This is a repeat contravention from inspection # CLAN-BRKPMQ
-Rust on the pipe on the gas meter was exposed. This could cause a potential health hazard. This is a repeat contravention from inspection # CLAN-BRKPMQ, and # CLAN-BJDQ9X
-A rusty metal pole and a handle were observed. Rust can present a health hazard. The rusty pole was removed during the inspection.
-A large amount of cigarette butts were located in a low container at the children's level. This could cause a potential poisoning hazard.
-Two large orange buckets with lids were easily opened. The buckets contained food waste that had a very strong odour. The Licensee stated this was compost.
-A bottle of charcoal starter chemical and cage cleaner enzyme were within easy reach of the children. These could present a potential poisoning hazard
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to their health and safety.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: The Licensees Criminal Record Check is expired.
Corrective Action(s): Please ensure to apply and receive a cleared criminal record check (CRC) prior to the previous CRC expiry date

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that the fire extinguisher has not been serviced annually. This is a repeat contravention from inspection # SSAU-C69S2K and # CLAN-BLCQF5
Corrective Action(s): Please ensure the fire extinguisher gets serviced annually to be prepared in an emergency.

NUTRITION AND FOOD SERVICES: 17120 - CCLR s.48(6) - A licensee must make available to parents information on the food and drink given to children.
Observation: During the inspection Licensing observed the menu that was posted. The lunch menu was posted in Chinese characters.
Corrective Action(s): Please ensure that the information on the food and drink given to children is posted in English in addition to Chinese characters.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Five children's records of seven records were reviewed. One children was missing a record of their immunization status.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing reviewed the attendance and noted that attendance was not completed for two days.
This is a repeat contravention from inspection #SSAU-C69S2K and #CLAN-BJDQ9X
Corrective Action(s): Please ensure attendance records are complete.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: During the inspection Licensing reviewed the children's records. The Licensee disclosed that one of the children's records was not on site as it was with his parent. The Licensee stated that the child was only attending the daycare for a limited time that day and recently started at the facility.
Corrective Action(s): Please ensure that all of the children's records are on site when the children are in attendance.

Comments

At the inspection dated November 2, 2022 there were 8 children and 2 staff and the Licensee was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by November 9, 2022 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Licensee.

The following education/recommendations were provided:
· Active Supervision
· Lead in the Water
· Using high chairs for eating purposes only was discussed.
