Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During this inspection the fridge temperature was 12c. The manager said she is not sure if this is because the fridge is too full or because it is old.
Corrective Action(s): For safe food storage the fridge temperature needs to be between 0-4C

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During this inspection the following were observed:
The fridge is in need of cleaning and has a broken crisper draw.
Kitchen walls have cooking grease stains throughout.
The stove top is in need of cleaning.
Dirty dishes are in the kitchen sink and on the kitchen counter.
A hole is in the bathroom wall where the door handle meets the wall.
Areas of the bathroom counter vinyl are coming away.
A broken towel rail is accessible to children in the bathroom.
Blinds in the main play room have multiple broken slats which are accessible to children.
Areas of foam are exposed on some nap mats making them hard to sanitize.
Walls and floors throughout the facility are in need of cleaning.
Corrective Action(s): The manager said she will start to clean the facility after the children are gone today.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11130 - CCLR s.15(3) - A licensee providing a care program to any child younger than 36 months of age must provide a separate sleeping area located away from any activity area.
Observation: The designated nap room is cluttered and is not accessible to a child who may need to nap outside of the regular nap time.
Corrective Action(s): The manager said she will make sure the nap room is cleaned up so that a child may use it if needed.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: The manger stated children have been playing in the front yard. Stairs accessing the street from the front yard are not fenced/blocked.
Corrective Action(s): The stairs to the street need to be made inaccessible to children.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation (CORRECTED DURING INSPECTION): The handrail on the stairs to the back yard from the house is broken/loose.
Corrective Action(s): The manger said children will not use these stairs until the handrail is fixed.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: During this inspection the following were accessible to children:
Cleaning products and cosmetic products in the bathroom.
Cleaning products in the kitchen.
Gardening equipment in the front and back yard.
Corrective Action(s): The manager will remove these items.

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: A criminal record check was not obtained a volunteer.
Corrective Action(s): The manager said she will apply for the volunteers criminal record check.

STAFFING: 12152 - CCLR s.19(5)(b) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for a volunteers.
Corrective Action(s): The manager said she will make sure the volunteer is fully screened.

STAFFING: 12153 - CCLR s.19(5)(c) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (c) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for a volunteer.
Corrective Action(s): The manager said she will get the volunteers immunization status.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The fire extinguisher decal had expired on January 11, 2024. There are not enough emergency supplies for eight children for 72 hours.
Corrective Action(s): The manger said she knew it had expired and would have the fire extinguisher serviced and that more emergency supplies will be added.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: A person who has no child care qualifications was providing care to the children for a period of time this morning while the manager was on an errand.
Corrective Action(s): Children must always be supervised by a person with an ECE or ECEA certificate.

RECORDS AND REPORTING: 19052 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: Files for eight children were reviewed. A record of a parent contract was not available in four files.
Corrective Action(s): The manager said she will make sure a copy of the parents contract is available in all files.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Files for eight children were reviewed. A medical insurance plan number was not available for four children.
Corrective Action(s): A medical insurance plan number must be available for all children.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: On review of time in/out records there were no entries for February 23, 2024 and only two children had been signed in for today.
Corrective Action(s): The manager said she will ensure time in/out is accurately kept.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Files for eight children were reviewed. Contact information for a doctor or medical clinic was not available in four files.
Corrective Action(s): Contact information for a doctor or medical clinic must be available for all children.

RECORDS AND REPORTING: 19380 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: A file was not available for one child. The manager said she is waiting for the family to bring the child's file back.
Corrective Action(s): A complete file must be available for all children while they are in care.

Comments

Summary of Inspection
At the inspection dated February 26, 2024 there were seven children and one staff and a volunteer present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site and a copy of this report will be emailed to the manager.
The following were discussed:
Ensuring the facility is kept reasonably clean at all times.
Using a janitorial service to deep clean the facility.
Ensuring the manger's children have complete files.
