Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): Licensee observed blind cords were hanging low enough for children to access them, posing a hazard.
Corrective Action(s): Please ensure that a healthy and safe environment is provided at all times while children are in care.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed two (2) staff files of which one staff file had an expired Criminal record check that was not site specific.
Corrective Action(s): Please ensure all staff files are complete and up to date.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing reviewed 2 staff files of which 2 files were missing validations.
Corrective Action(s): Please ensure all staff files are complete and up to date.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that the fire extinguisher had no evidence of when it was last serviced. This is a repeat contravention from inspection # JDOO-CLLNRF
Corrective Action(s): Please ensure the fire extinguisher is serviced annually.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensee indicated that they have done fire drills however she has no written record of this.
Corrective Action(s): Please enusre you keep a record of all drills.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: Licensing reviewed children's files and observed two childrens files were completely missing.
Corrective Action(s): Please ensure you keep a record for all children that are in care.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed four children's records of which 1 file was missing an MSP number
Corrective Action(s): Please ensure all children's records are complete and up to date.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing reviewed attendance records and there was no record of attendance for the day.
Corrective Action(s): Please ensure you keep a daily record of attendance.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing reviewed 4 children files of which 3 were missing emergency contact name and phone number.
Corrective Action(s): Please ensure all children's files are complete and up to date.

Comments

At the inspection on August 22nd, 2023 there were 6 children and 2 staff present.
At this inspection, the above noted contraventions were identified.
