Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): During the inspection Licensing observed the following:
-A staff backpack was observed on the ground. This was accessible to children. This is a repeat contravention from inspection #CLAN-BH2Q3X, #CLAN-CLEN4Y
-A bottle of bleach was observed on the floor in an unlocked cupboard.
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to their health and safety.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed the staff records. One staff record had a criminal record check (CRC) from another Country. The serious health and safety risk to children in care was discussed with the Manager.
Corrective Action(s): Please ensure each staff working at the facility completes and receives a clear criminal record check from the CRC review board prior to starting employment at the facility. A plan is required to be submitted by the Manager to mitigate any potential risk.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): Immunization status was not obtained for one employee.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: The staff records were reviewed. One staff record did not have a ECE verification from the ECE Registry.
Corrective Action(s): Please ensure staff records are complete.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed the emergency supplies. There was insufficient food available in case of emergency. In discussion the Manager stated that the food had expired and she has not replaced it. This is a repeat contravention from inspection #CLAN-CBYN2W
Corrective Action(s): Please ensure you have sufficient food in the emergency supplies to be prepared in a potential emergency.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed the paper towels for drying children's hands are far away from the sink used for handwashing. Please ensure paper towels are placed in the washroom or directly outside the washroom to ensure children practice proper hygiene practices and have supplies readily available. This is a repeat contravention from inspection #SMOY-BRJTAH
Corrective Action(s): Please ensure to practice proper hygiene practices.

Comments

At the inspection dated September 20, 2023 there were 17 children, 2 staff and the Manager was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by October 4, 2023, unless otherwise specified in this report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was provided to the Manager.

The following was discussed with the Manager:
· Reportable Incidents
· Lead in the Water
· Active Supervision
· The maintenance painting plan for the facility
· Relocating objects that may present a potential falling hazard
