Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following that are accessible to children in care:
-a plunger, a toilet bowl scrubber and a mop & bucket beside a toilet in one of the bathrooms.
- along one side of the facility there was a hose spread all over the cement area. This is a potential tripping hazard. There was also a broken piece of wood (from the wooden cover for the sandbox) with 2 nails sticking out of it. (Corrected during inspection).
- part of the fence by the gravel play area is not sturdy and leaning back into the neighbours back area.
-there were several wood pieces, long plastic pieces and a metal gate (with sharp edges) on one side of the facility.
-on one side of the wooden staircase leading up to the porch there were 3 rusted nails sticking out.
Corrective Action(s): Please ensure that a safe and healthy environment is provided, at all times, to children in care.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Upon review of 5 staff files, Licensing observed that 1 staff's file was without references.
Corrective Action(s): Please ensure that all staff files are complete.
Date to be Corrected: April 12, 2019.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Upon review of 5 staff files, Licensing observed that 2 staff files were without a resume.
Corrective Action(s): Please ensure that all staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Upon review of 5 staff files, Licensing observed 1 staff's file without immunization status.
Corrective Action(s): Please ensure that all staff file's are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Upon review of 5 staff files, Licensing observed 1 staff's file without proof of validation, from the early childhood registry, of their certificate.
Corrective Action(s): Please ensure that all staff files are complete.
Date to be Corrected: April 18, 2019.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Upon review of 5 staff file's, Licensing observed the following:
- 1 staff's criminal record check was expired.
-1 staff's certificate was expired.
Corrective Action(s): Please ensure that all staff's records are current.
Date to be Corrected: April 18, 2019.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that all the food and water in the emergency bag was expired.
Corrective Action(s): Please ensure that an emergency plan is in place that will allow the children in care and staff to recover from any emergency.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon review of April's attendance records, Licensing observed that on 1 day a child's departure time was not indicated.
Corrective Action(s): Please ensure that attendance records are accurate on a daily basis.

Comments

Summary of Inspection
At the routine inspection conducted today, April 8, 2019, there were 12 children and 3 staff present. At this inspection the above noted contraventions were identified. The Manager is required to correct all identified non-compliances by the dates indicated above in the violations section. A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
