Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act, Child Care Licensing Regulationand the relevant Director of Licensing Standards of Practice. Evidence for this report was based on the writer's observations, review of the facility records, and information provided by the facility staff at the time of the inspection.

The following areas were reviewed:
Licensing
Physical Facility
Staffing
Policies and Procedures
Care and Supervision
Hygiene and Communicable Disease Control
Medication
Nutrition and Food Services
Program
Records and Reporting.

As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The risk assessment tool includes any violations identified during the routine inspection, and a 3 year 'historical' review of the facility's compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #SMOY-AUQRGA have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: The writer observed some of the staff's certificates posted however the most recently hired staff have yet to post their certificates.

Corrective Action(s): Ensure all educators and/or assistants post their certificates.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation (CORRECTED DURING INSPECTION): The Licensee did not have criminal record clearances for all of the staff. Since the July 27, 2018 inspection the Licensee has applied for clearance letters for all outstanding individuals and is awaiting the results.

Corrective Action(s): Ensure all staff have a criminal record clearance letter on file prior to working with children.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation (CORRECTED DURING INSPECTION): During the July 27, 2018 inspection the writer noted that some staff had criminal record clearance letters on file that were addressed to a different Licensee.

Corrective Action(s): Ensure all staff employed at this facility has a criminal record clearance letter on file for this Licensee.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): On July 27, 2018 the writer noted that the staff to child ratio was not met upon their arrival in Classroom B.
Corrective Action(s): The Licensee indicated that a staff member who was scheduled to work in the program had not come in to work. The Licensee combined the children and staffing from Classroom A and B in order to meet the legislative requirements.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: The Licensee has the children file's organized by classrooms. Upon review of the children's files on July 27, 2918 the writer noted some children in attendance did not appear to have a file on site.

Corrective Action(s): On August 10, 2018 the Licensee provided to the writer complete and organized files for all children in each of the classrooms. All information is complete.

RECORDS AND REPORTING: 19140 - CCLR s.57(2)(h)(i) - A licensee must keep, for each child, a record showing the following information: (h) any special instruction respecting the child's diet, medication, participation in a program of activities, or other matter relevant to the child's care, (i) given by the child's parent to the licensee in writing.
Observation (CORRECTED DURING INSPECTION): The writer noted some children in care have allergies that a medical device may be needed to address an allergic reaction however no care plan was available.

Corrective Action(s): On August 10, 2108 the affected children's care plans were complete and readily available.

Comments

During the inspection of July 27, 2018 the Licensee was present for the inspection and the writer was informed that one of the staff who was scheduled to work today did not show up for work and the Licensee was part of the staff to child ratio for today. There were 23 children in care in the two group child care (30 months to school age) programs with 3 staff and 5 children in the group child care (school age) with 1 staff.

The writer was able to conduct a partial inspection which included reviewing some facility records, physical premises and some staff and children interactions. The writer was unable to complete the inspection without the assistance of the Licensee and/or staff. The writer will be away from the office on July 30, 2018 and will return on August 7, 2018. The writer and the Licensee arranged for the writer to return on Friday, August 10, 2018 at 1pm to complete the inspection and review the report. The writer did not observe any obvious health and safety hazards on July 27, 2018.

The writer met the Licensee on August 10, 2018 to completed the routine inspection. The Licensee and staff have worked really hard since July 27, 2018 to bring all of the paperwork into order. The staff and children files are well organized and easily accessible. The Licensee has demonstrated to the writer that they are able to bring their facility into compliance with the legislative requirements.
