Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following was observed downstairs:
-toys were stored on the top of a tall shelf with the potential to fall.
-a tall shelf is unstable and moves when pushed on.
-a tile towards the emergency exit at the front door is broken and moves when stepped on.
-Clothes were hanging on a rack beside a play pen used for sleeping with the potential for the child to pull the clothes down.
The following was observed upstairs where children were at time of arrival:
-the laminate flooring at the top of the stairs was loose and posed a tripping hazard.
-Items and clothes were piled high beside a couch where children were sitting with the concern that the items might fall on children.
-Dog feces were observed in the outdoor play area.
Corrective Action(s): Address the concerns above to insure a healthy and safe environment.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: The emergency exit to the front door was blocked with items. The Licensee stated they will be moved.
Corrective Action(s): Ensure that the supplies are not blocking or hampering the emergency exit.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Lysol wipes were accessible to children under the bathroom sink. The Licensee made the wipes inaccessible at time of inspections.
Corrective Action(s): Ensure that hazardous items are inaccessible to children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11250 - DLSOP Family Child Care [n4] - The size of the area that is designated to be used by the children in care should, at a minimum, meet the basic physical space requirements of group child care (i.e. 3.7 m² per child of usable floor area, 7m² per child of outdoor play area)
Observation: The main play area has 2 large activity tables that seat 6 children and a large train table, a large piano, a large cabinet, 10 toy selves and a small child sized table for 2 in the area, leaving little floor space for children to use. The Licensee stated that she is going to remove some items to have floor space for children to use.
Corrective Action(s): Ensure that there is a minimum of 3.7m2 floor space available to children in the designated area.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: 1 person living in the home did not have a criminal record check.
Corrective Action(s): Ensure that each person over the age of 12 ordinarily present on the premise has obtained a criminal record check.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The Licensee stated that they completed fire drills and emergency plan but did not have a record of it.
Corrective Action(s): Ensure that a record is kept respecting compliance with section 22(2)(b) and (c).

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: The Licensee stated that she doesn't have an active play policy or screen use policy.
Corrective Action(s): Ensure that an active play and screen use policy is developed and distributed to families.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: 1 of 5 children did not have a current file containing records set out in section 57.
Corrective Action(s): Ensure that all children have a current file.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: The Licensee was unable to access photos of children to readily identify them in an emergency.
Corrective Action(s): Ensure that a record of a photo or digital image of the child to readily identify the child is available.

Comments

Summary of Inspection
At the inspection dated February 27, 2020 there were 4 children, 1 staff, and 1 person living in the home present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response and complete a follow up inspection.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:

· Lead in the Water
