Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: ECE certificates were not posted for most staff in the programs. The Manager explained that they are in the process of creating coloured copies of the certificates and these will be posted in the programs once completed.
Corrective Action(s): Please ensure ECE certificates are posted in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: In the Infant 1 program's washroom, it was observed that a bucket with a backpack was placed on the toilet seat.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A criminal record check from the Criminal Records Review Program was not obtained for one staff. An RCMP check was available and education was provided on obtaining the required CRC.
Corrective Action(s): Please ensure staff files are complete as per the legislation.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: One child was not signed in in the Infant 1 program and one child was not signed in in the Toddler 4 program.
Corrective Action(s): Please ensure that daily attendance is recorded for each day including the time of arrival and departure.

Comments

At this inspection there were 72 children and 17 staff and the Manager present. At this inspection the above noted contraventions were identified. Action required by the manager include a written response addressing the contraventions and action required by the LO will be to review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were discussed:
Criminal Record Checks as required by the legislation must be obtained from the Criminal Records Review Program in Victoria. If a staff has a current CRC from CRRP, the CRC may be shared using the sharing program
ECE certificates of staff must be posted in a prominent place
