Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR)and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed and discussed the following with the Manager:
- Art Room: Laundry detergent placed on top of the laundry machine is accessible to the children.
-Washer and dryer front load machines were not locked.
- Outdoor play space: landscape fabric under the woodchips are showing posing tripping hazard. The play structure has a slide and saucer swing with no sufficient clearance area.
Corrective Action(s): Ensure that a healthy and safe environment is provided at all times while children are in care.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Staff member's CRC on file is not site specific.
Corrective Action(s): Ensure that all staff files are complete.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for a staff member.
Corrective Action(s): Ensure all staff files are complete.

Observation: A record of the person's work history was not obtained for a staff member.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Staff member's immunization status was missing on their file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Staff member's certificate was not validated by the ECE registry.
Corrective Action(s): Ensure that all staff files are complete.

NUTRITION AND FOOD SERVICES: 17120 - CCLR s.48(6) - A licensee must make available to parents information on the food and drink given to children.
Observation: Parents were not made aware of the food ( morning/afternoon snack) provided to the children.
Corrective Action(s): Ensure that parents are provided with information on the food and drink given to children.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 4 children's files were reviewed; 1 child's records were not available onsite.
Corrective Action(s): Ensure that all children's files are complete.

Comments

At the inspection dated November 15, 2023 there were 7 children, manager and a practicum student present. At this inspection above contraventions were identified. The Licensee is required to take corrective actions to bring the facility into compliance and submit a written response to Licensing for review by below date. As part of this Routine Inspection a Facility Risk Assessment Tool is completed.
