Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Two persons present on a regular basis at the facility have RCMP criminal record checks.
Corrective Action(s): The manager will ensure all persons present at the facility have a criminal record check from the CRRP in Victoria.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Four staff files were reviewed. Evidence of reference checks being conducted was not available in two files.
Corrective Action(s): The manager will ensure evidence of reference checks being conducted is available at the facility.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Four staff files were reviewed. Evidence of a resume being obtained was not available in two files.
Corrective Action(s): The manager will ensure evidence of resumes being obtained for all staff is available.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Four staff files were reviewed. Immunization status was not available for three staff.
Corrective Action(s): The manager will e sure immunization status is available for all staff.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Four staff files were reviewed. Evidence of certificates being verified was not available in any file.
Corrective Action(s): The manager will ensure evidence of certificates being verified is available in all files.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: A record of absences is not being recorded.
Corrective Action(s): The manager will ensure all absences are recorded.

RECORDS AND REPORTING: 19140 - CCLR s.57(2)(h)(i) - A licensee must keep, for each child, a record showing the following information: (h) any special instruction respecting the child's diet, medication, participation in a program of activities, or other matter relevant to the child's care, (i) given by the child's parent to the licensee in writing.
Observation: Care plans for three children were not available.
Corrective Action(s): The manger will ensure that written instructions regarding the care of all children with additional needs are available.

Comments

Summary of Inspection
At the inspection dated April 12, 2024 there were 20 children and four staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written on site. A copy of this report will be emailed to the manager.
The following were discussed:
Ensuring written permission from families is obtained to apply any lotions to children.
Making sure all bike helmets correctly fit the child who is wearing it.
Ensuring all families provide an out of town emergency phone number a required by the facility policy.
All staff must be fully screened before they start work and evidence of full screening available.
