Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During inspection in the infant and toddler program:
- Licensing observed one of the playroom was cluttered with toys. Manager said that this room is not currently used for children, however during inspection Licensing observed one staff use the playpen in this room for napping one child and for play use for two children. Licensing discussed maintaining licensed space at all times even when it is not in use to facilitate additional programming.
- Licensing observed infant toddler floor surfaces were in need of sweeping with visible dirt ,dust particles, small dried leaf particles, hair strands and small pieces of paper in the corner edges of the rooms .The Manager said that staff cleans the facility twice a week and that transitions from outside to inside is when children bring dirt indoors. Importance of maintaining daily and general cleanliness of the facility and clutter was discussed with the Manager.

Corrective Action(s): Please ensure that the facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: During inspection of the infant and toddler outdoor play space:
-Licensing observed that two pieces of climbing equipment did not have 6 feet clearance all around it. These pieces of climbing equipment were in close proximity to the wooden fence, other toys and a tree stump. Licensing expressed concern that it posed as injury hazard.
-An opening of approximately 4 inches was measured under one of the wooden fences. Licensing expressed concern as it posed as an entrapment hazard.
Corrective Action(s): ·Ensure all climbing equipment has 1.8 metres (6 feet) clearance all around it and all the holes and opening measure less than 3.5 inches.(DOLSOP)

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one employee.
Corrective Action(s): ·Ensure all staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Four staff files were reviewed and one was missing a Criminal Record Check.

Corrective Action(s): Please ensure all staff files are complete.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Although manager has food for 72 hours in the emergency response kit, during inspection staff in the infant and toddler program could not locate where the supplies were kept.
Corrective Action(s): Please ensure there is enough water for all children and staff for 72 hours to respond to and recover from any emergency.

Comments

At the inspection dated November 8, 2022 there were seventeen children, four staff and the Manager present. Licensing conducted a walk-through of the entire facility. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by November 11, 2022. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the Manager:
Ground surfacing in the outdoor play area is wearing thin in some areas. Manager said that she will look into getting mulch redistributed.
Lead in Drinking Water
De cluttering of toys indoor and outdoor for ease of cleaning
Manager stated that the path used as an emergency exit in the infant and toddler program is currently in the process of reorganization and cleanup due to a recent renovation.Outdoor wooden gate latch was broken and Manager will repair or replace it. Licensing discussed placement of items indoors and outdoors in a way that does not pose as a hindrance during an emergency.
Challenges of accessing and storage of children's photos on an app or the Manager's cell phone as the single source as it may make retrieving these photos difficult if there are technological malfunctions.

The inspection report was written on-site and details were reviewed with the Licensee contact prior to writing the report. A copy of the routine inspection report and risk assessment is provided to the manager at this inspection.
