Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: A large metal play structure in the children's outdoor space has a broken section with a jagged rusty edge. The manager explained that the facility is awaiting repair of the equipment and during the inspection covered the jagged rusty edge with heavy tape.
Corrective Action(s): Ensure that the equipment is in good repair.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): Of the five staff files reviewed, two did not include immunization status.
Corrective Action(s): The manager obtained immunization status during the inspection.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: Licensee explained that employees do not practice the emergency plan annually.
Corrective Action(s): Ensure to practice the emergency plan at least once each year.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation (CORRECTED DURING INSPECTION): Licensee confirmed that fire drills are conducted monthly; however, a record has not been maintained.
Corrective Action(s): A record of fire driills that have been conducted was created during the inspection.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: There were unclear written directions specified by the parent regarding the administration of medication.
Corrective Action(s): Ensure to obtain written directions by the parent regarding administration of medication.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: No care plan available for a child requiring extra support.
Corrective Action(s): Ensure to obtain a care plan for each child requiring extra support.

During this inspection, the above noted contravention was identified and corrected during the inspection. As part of this Routine inspection, a Facility Risk Assessment Tool was completed.
