Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 2 staff files and noted one did not contain a record of certificate verification. This is a repeat contravention.
Corrective Action(s): Ensure all educator and educator assistant certificates are verified using a system established and maintained by the early childhood registry.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Licensing reviewed 2 staff files and noted 1 file contained an expired criminal record check.
Corrective Action(s): Ensure current records are kept for each employee, records required under section 19(1) of the CCLR.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Upon inspection, licensing noted food in the emergency bin was expired, and there were insufficient supplies to respond to and recover from an emergency.
Corrective Action(s): Ensure the emergency plan and supplies are current and available to mitigate, respond to and recover from any emergency.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation (CORRECTED DURING INSPECTION): Licensing reviewed 6 children’s records and noted 1 was missing date of enrolment. The Manager recorded date of enrolment while licensing was on site.
Corrective Action(s): Ensure children's records contain all required information, including date of enrolment.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing reviewed 7 attendance records and noted 9 departure times were not recorded.
Corrective Action(s): Ensure a record is kept for each child indicating whether the child is absent, or if the child is present, the time of arrival and departure.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Licensing reviewed 1 care plan, the Manager said the care plan had not been reviewed within the past year.
Corrective Action(s): Ensure care plans are reviewed at least once each year with a parent, and any person requested by the parent.

Comments

At this inspection, there were 8 children, 1 staff and the Manager present. At this inspection, the above noted contraventions were identified.
The following was discussed with the Manager:
· Emergency management

The Licensee is to correct the contraventions by the dates indicated, and provide a written response to licensing.

As part of the routine inspection, a Facility Risk Assessment Tool was completed.

The inspection report was written off-site due to COVID-19 protocol – all details were reviewed with the Manager prior to writing the report. A copy of the inspection report and risk assessment will be e-mailed to the Manager.
