Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): Licensing officer observed the following in the play area where children were playing:
·One curtain tie strap was accessible to children
·On the upper portion of the wall one thumb tack pin was protruding loosely and appeared it would fall out easily at the slightest touch to that wall.
·Window blind cord was accessible and within reach to children
Corrective Action(s): Please ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: In the outdoor play area licensing observed:
·Wear and tear on the two wooden fence panels making them loose and easily movable upon slight touch. Manager is aware that these two wooden fence panels are loose and have made an attempt previously to secure them.
·Door to the garage was unlocked. Manager stated that door is usually locked and will look into changing the door.
Corrective Action(s): Please ensure that the entire play area is enclosed to ensure children are free from harm.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: Two residents who live in the home require a current criminal record check. Licensee stated that criminal record checks have been applied two weeks ago. Licensing officer verified and viewed the submitted applications once I was back in the office.
Corrective Action(s): Please ensure all residents over the age of 12 who live in the home have a current criminal record check.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Manager’s ECE certificate expired 16 June 2021. Manager was not aware that ECE certificate had expired last week. Licensing was informed that she will be mailing the renewal application this weekend.
Corrective Action(s): Please ensure the staff to child ratio is as per Schedule E of the Child Care Licensing Regulation. Inform licesning when renewed ECE cretificate is received.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation (CORRECTED DURING INSPECTION): Licensing observed a child did not wash hands after using the bathroom. Proper hand washing to reduce the spread of illness was discussed with the manager.
Corrective Action(s): Please ensure that the rules of health and hygiene are practiced.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: 3 children's files were reviewed and one child's file was missing consent to call a medical practitioner or an ambulance in case of accident if the parent cannot be reached immediately.
Corrective Action(s): Please ensure to have all children's records complete and available.

Comments

At the inspection dated June 24, 2021 there were eight children and one staff present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility. A secondary licensing officer was present for training purposes.
The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the manager:
· Safe storage of garden hose to prevent strangulation
· First aid to be recertified by 6 July ,2021
· Contents of the Earthquake Emergency Kit
· Spring cleaning and maintenance of outdoor play area
· Ground surfacing in the outdoor play area is wearing thin in some areas. Manager stated she is aware and is looking into getting it replaced or redone by a professional service.

The inspection report was written off-site – details were reviewed with the Manager prior to writing the report. A copy of the routine inspection report and risk assessment sent to manager via email on June 25, 2021 Total time includes writing report in office.
