Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLP). Evidence for this report was based on the licensing Officers observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed: Licensing, Physical Facility, Staffing, Policies & Procedures, Care & Supervision, Hygiene and Communicable Disease Control, Medication, Nutrition and Food Services, Program, Records and Reporting.
As part of the Routine Inspection a Facility Risk Assessment is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation .environment

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation (CORRECTED DURING INSPECTION): CRC for one staff was not in place during the LO's inspection of staff files. This was corrected during the inspection.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Staff stated a different location than what is stated in the parent information package as to where the evacuation site is.. Staff were unaware of how to access their emergency supplies - a key was eventually found by the manager. An evacuation drill to the site has not been practiced.
Corrective Action(s): Ensure that emergency plans and procedures are in place.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: A review of children's records shows that there are more than the allowable two children under the age of 36 months in care at the same time on occassions.
Corrective Action(s): Ensure that groups do not exceed what is permitted in Schedule E. Please provide licensing with a plan as to how group sizes will be met in the future.

RECORDS AND REPORTING: 19050 - CCLR s.56(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: The staff and manager stated that a log of minor incidents is not kept. While there is a process in place to communicate to parents when a child has a minor incident, it does not meet the intent of the legislation that states a log must be kept.
Corrective Action(s): Ensure a log of minor incidents is kept.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation (CORRECTED DURING INSPECTION): Upon arrival, there were some children that did not have photographs on site. Manager stated to staff that these were available on the phone. Staff corrected this during the inspection by taking a photograph of a child.
Corrective Action(s): Ensure photographs are available to readily identify a child in the event of an emergency.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: According to staff, the manager and children's records, there is one child requireing a care plan, however this care plan is not in place.
Corrective Action(s): Ensure that any child requiring extra support has a care plan in place.
Date to be Corrected: Prior to this child being in attendance again.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Upon arrival there was one child in care with no records. This child appeared to be very young and licensing queried if the child was old enough to attend the program. There was no record of how old this child was. There were records for this child's sibling.
Corrective Action(s): Ensure children's records are in place prior to children attending.
Date to be Corrected: Prior to this child being in attendance again.


Comments

Discussions were had around the Active Play Standards of Practice that are now part of our regulations.
Live 5210 Information package was discussed today. The package will be mailed to this facility in the near future.

Temporary Placement and Exemption processes were discussed.

There were many opportunities for a variety of areas of development including dramatic play, threading, coloring and fine motor manipulatives. The children were seen to practice hand washing prior to eating and participate in outside play. The caregivers were seen to be responsive, kind and a respectful with the children. "Thank You, "Here we go", and intervening to guide conflicts.
