Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

The following areas were reviewed:

· Policies and Procedures
· Care and Supervision
· Hygiene and Communicable Disease Control
· Medication
· Program
· Records and Reporting

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11130 - CCLR s.15(3) - A licensee providing a care program to any child younger than 36 months of age must provide a separate sleeping area located away from any activity area.
Observation: It was identified that staff from one of the under 36 months programs have not been using the separate sleeping area. Staff stated they were unaware that their program had a designated sleep are that was outside of the classroom. To date, if children required to nap outside of the scheduled nap time, they have been sleeping in an area off to the side of the room that is located next to an activity area.
Corrective Action(s): Please ensure all under 36 months programs use their separate sleep areas.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed 6 staff files and observed that 2 staff were missing record of a criminal record check.
In addition, it was identified that an individual who has been ordinarilly present does not have a criminal record check.
Corrective Action(s): Please ensure compliance with criminal record check requirements. Licensing is requesting a written response identifying health and safety measures taken pending criminal record check results.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing reviewed 6 staff files and observed that record of immunization status was missing for 2 staff.
Corrective Action(s): Please obtain, for each staff, a record of their immunization status prior to employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 6 staff files and observed that certificates were not verified for 2 staff.
Corrective Action(s): Please ensure staff certificates are verified prior to employment.

STAFFING: 12390 - CCLR s.38(b) - If for any reason an employee described in Column 1 of the table in section 37 [absent employees] ceases employment, (b) the licensee must ensure that, within 30 days of the date the employee ceases employment, the licensee has sufficient staff to meet the requirements of section 34.
Observation: It was identified that a new manager has been appointed. However, Licensing was not made aware of this change.
Licensing will provide the licensee contact with the required forms to amend the manager information.
Corrective Action(s): Please ensure Licensing is notified when there is a change in manager.

POLICIES AND PROCEDURES: 13071 - CCLR s.56(2) - A licensee must ensure that the policies and procedures referred to in subsection (1) are implemented by employees.
Observation: It was identified that the supervision policy in regards to when programs from the same service type are combining on the playground has not been shared with staff.
Corrective Action(s): Please share the facilities policies and procedures with all staff so that the policies can be effectively implemented.

Comments

The following was discussed:

Break relief coverage;
Staffing schedules;
Monitoring system for keeping track of the children who are sleeping in the nap room;
Gradual entry procedure;
Different ways to obtain evidence of character reference checks if only a list of names and numbers has been provided;
Ensuring that the nap area next to the teacher's work station is cleared of materials once the under 36 months program is operating;
Reportable incident process.

A follow-up inspection is required because all newly licensed facilities receive one routine and one follow-up.
