Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
Licensing completed this report at the Licensing office on May 26, 2016 from 2:00-3:30 pm.
Licensing delivered this report to manager on May 27, 2016 from 10:30- 11:30 am.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The fridge temperature was measured at 5.5 degrees Celsius. The manager stated that the fridge is not used for childrens' food.
Licensing observed that the childrens' lunches contained ice packs.
Corrective Action(s): Please ensure that children do not eat any foods stored in this fridge as it is not cold enough to keep food safe for consumption.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing reviewed the staff records and found that one staff was missing information regarding their immunization status.
Corrective Action(s): Please ensure that all staff records are complete as required.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: Upon arrival, there were 11 children present at the facility. There were 8 children in the Multi-Age program and 3 children in the School Age program. These 3 children are 5 years old but do not attend school yet and during the school day the School Age program is not in session. Later in the morning another child arrived.
On May 10, 2016, the attendance reports showed that there were 9 children present in the Multi-Age program.
Corrective Action(s): Please ensure that you ensure that at all times you operate according to your licence.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed that the School Age children were not signed in and out correctly.
Corrective Action(s): Please ensure that the attendance sheets reflect the comings and goings of children accurately and at all times.

Comments

The manager submitted an Application for Licence to amendment the licence.
Please provide a response to Licensing regarding operating in non-compliance. The onus is on licensee to operate the facility according to the licence.
At the time of the inspection, there were 4 children more than allowable with your current licence.
On May 27, Licensing drove by Heritage Mountain Day Care and found that the 2 staff were on a walk with 11 children
Licensing has minimal standards to ensure the health and safety of children.
