Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Character references in respect of a staff was not obtained for one employee.
Corrective Action(s): Ensure there is a record of character references for staff on file.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for one employees.
Corrective Action(s): Ensure there is a record of person's work history on file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for the Licensee and a staff. The Licensee stated both individuals are fully vaccinated.
Corrective Action(s): Ensure there is evidence persons have complied with the Province's immunization status.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: Licensing noted 2 individuals who are ordinarily present on thre premise have an expired criminal record check.
Corrective Action(s): Ensure all individuals who are ordinarily present on the premise have a current and vaild criminal record check.

Summary of Inspection:
At the inspection dated November 28, 2022 there were 3 children in care with the Licensee.
At this inspection the above noted contraventions were identified.
Action required by the licensee includes providing a written response by December 5, 2022 .
Actions required by Licensing include reviewing the written response.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report. The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.
