Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

Policies and Procedures
Care and supervision/Hygiene and medication
Nutrition
Program
Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Contraventions
Previous Inspection -
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: On review of staff files, Licensing observed that the Licensee/Manager did not have a current Criminal Record check clearance on site. Licensee stated that this was an issue last routine inspection and that a copy is held at the Surrey office.
Corrective Action(s): This staff never works alone. Licensing will check the office facility file and if in place, will provide a copy to the Licensee. Please ensure a copy of all staff criminal record checks remain on site.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: On review of 2 current staff files and 2 substitute staff files and verification was not in place for any of the certified staff.
Corrective Action(s): Please ensure that all ECE and ECEA certified staff are verified through the ECE Registry.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: On review of staff files on site today, Licensing observed that both staff have expired First Aid certificates.
Corrective Action(s): Children must have immediate access to employees with first aid. Please provide a health and safety plan to ensure the risk to children is mitigated.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing reviewed a random selection of 6 children's files and observed that each were missing the enrolment dates. Licensing did observe that there were signature dates on the registration forms for different information but some were not the same date so can't be used as enrolment dates.
Corrective Action(s): Please ensure all children's files have an enrolment date.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the Licensee/Manager with 1 other staff and 9 children. 1 other child was visiting as a prospective child.

Staff to child ratio was in compliance with regulations
Programming is posted and available for parent review
Licensing observed the children in free play with a variety of activities to choose from. Children had 10 minutes of outdoor play before snack time. Hand washing was observed.

Discussions with the Manager/Licensee:-
- Licensing reviewed the evacuation procedures with the Manager
- Licensing provided information regarding Appetite to Play (see website) and provided the immunization poster as a resource.
- Licensing recommends having a monitoring system in place to ensure staff record documentation. All sub staff files need auditing for up to date information.
Licensing observed Staff engaged with children meeting individual needs and communicating with appropriate language and guidance.
Licensee requires an amendment application to change Licensee name. Licensing will email document.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
