Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: In the Group Child Care (30 months to School Age) program, an electrical outlet was found to be uncovered and a heavy wooden box of wooden blocks was observed on a shelf accessible to children that could cause injury if it were to fall on a child. In one of the Group Child Care (Under 36 months) programs, a wooden plank was observed sitting on top of a toy bin shelf accessible to children that could also cause injury to a child if it were to fall.
Corrective Action(s): Please ensure a safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Chipped paint exposing drywall and baseboards with chipped paint were observed in one of the Group Child Care (Under 36 Months) programs.
Corrective Action(s): Please ensure facility is in good repair.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensee explained that 6 staff have Criminal Record Checks from other organizations and that new Criminal Record Checks have been applied for.
Corrective Action(s): Please ensure appropriate Criminal Record Checks are in place prior to staff starting to work in the facility.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 6 staff records were reviewed and one was found to be missing immunization status.
Corrective Action(s): Please ensure staff have immunization status on record.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensee stated that ECE Certificates had been verified but evidence of verification was not on record.
Corrective Action(s): Please address.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Licensee explained that some fire drills have taken place but they have not been practiced monthly.
Corrective Action(s): Please ensure fire drills are practiced monthly.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Emergency supply kits were observed and found not to contain enough food and water for the number of children in care.
Corrective Action(s): Please ensure supplies are sufficient to be able to respond to an emergency appropriately.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensee explained that not all fire drills have been recorded.
Corrective Action(s): Please ensure fire drills are recorded monthly.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Attendance records were reviewed and found to be missing some times of departure in the Group Child Care (30 Months to School Age) program.
Corrective Action(s): Please ensure children's departure times are recorded.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: A care plan for a child had not been reviewed within the past year.
Corrective Action(s): Please ensure care plans are reviewed at least once each year.

RECORDS AND REPORTING: 19330 - CCLR s.59(b) - In respect of a record referred to in this Division, a licensee must (b) keep a record other than one referred to in paragraph (a) in a place from which it can be retrieved within a reasonable time, on request.
Observation: Licensee had developed an Active Play and Screen Use policy but was unable to find a written copy of the policies at todays inspection.
Corrective Action(s): Please ensure a written copy is available for Licensing to review and for staff to reference.

Comments

At the inspection dated October 23 the above noted contraventions were identified.
Action required by the Licensee: Address contraventions and provide a corrective action plan.
Action required by the Licensing Officer: Review corrective action plan and conduct a follow up inspection.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was provided.
