Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One staff person does not have a criminal record check completed through the Criminal Record Review agency in Victoria. That staff person currently has a clear criminal record check from the RCMP on file at the facility. Manager stated that criminal record check has been applied through the Criminal Record Review agency in Victoria and they are still awaiting the results.
Corrective Action(s): Please ensure all staff persons have a criminal record check done through the Criminal Record Review Agency in Victoria.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: During inspection Licensing reviewed four staff files. One staff file was missing evidence that references were verified. Manager stated that she did verify this staff’s references but is unsure why the documentation is not available in the staff file. This is repeat contravention from routine inspection # WBET-BZDQR9 dated March 23, 2021.
Corrective Action(s): Please make sure all staff files are complete before they start employment.

RECORDS AND REPORTING: 19330 - CCLR s.59(b) - In respect of a record referred to in this Division, a licensee must (b) keep a record other than one referred to in paragraph (a) in a place from which it can be retrieved within a reasonable time, on request.
Observation: During inspection one staff’s records was unavailable at the facility. Manager emailed this staff's documentation to Licensing after the inspection
Corrective Action(s): Staff records must be accessible upon request within a reasonable time.

Comments

At the inspection dated February 1, 2022 there were twenty five children and three staff present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility including outdoor play area.
The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by February 4, 2022. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the Manager:

· Replenishing contents of the first aid kit when supplies are running low
· Accessibility of staff records
The following resources were provided and discussed:
· BCCDC Child Care Guidance,updated 19 Jan 2022. (via email)
· LO business card

The inspection report was written off-site – details were reviewed with the Manager prior to writing the report. A copy of the inspection report was provided via email to the manager on February 2, 2022. Total time includes writing report in office.
