Introduction

An unannounced routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), Child Care Licensing Regulation (CCLR)and the relevant Director of Licensing Standards of Practice. Evidence for this report was based on the writer's observations, review of the facility records, and information provided by the facility staff at the time of the inspection.

The following areas were reviewed:
Licensing
Physical Facility
Staffing
Policies and Procedures
Care and Supervision
Hygiene and Communicable Disease Control
Medication
Nutrition and Food Services
Program
Records and Reporting.

As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The risk assessment includes any violations identified during the routine inspection, and a 3 year 'historical' review of the facility's compliance and operation.

The Facility Manager was present for the latter half of today's inspection.

Contraventions
Previous Inspection - Contraventions observed on FIR #SMOY-A32M7A have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): Upon review of the children's files the writer noted there are 3 children enrolled who will not be 3 years of age as of December 31st.

Corrective Action(s): The writer spoke with the facility manager and was informed there are three individuals responsible for enrollment and an error was made when enrolling these children. The facility manager completed an application for an exemption to request these three children be permitted to continue to attend until December 31st 2016. The facility manager will speak with the individuals responsible for enrollment and point out the requirement that a child must be 30 months of age upon enrollment and turn 3 years of age by December 31 in the year they enroll.

PROGRAM: 18060 - CCLR s.44(3)(4)(5) - A licensee, other than a licensee providing a care program described as Occasional Child Care, must provide each child with daily outdoor play periods unless weather conditions would make it unreasonable to do so. (4) Despite subsection (1), a licensee who provides a care program described as Occasional Child Care need not provide a program of outdoor activities.
(5) Despite subsection (3), that subsection applies to a licensee who provides a care program described as Child-minding only if the program provides care for 3.5 hours or more each day.
Observation: In discussion with the facility staff it was noted that the program does not go outdoors on a daily basis. The staff will take the children for a walk within the mall but not always outdoors.
Corrective Action(s): The legislation does require preschool programs to go outdoors on a daily basis (sun, rain, snow etc). There is a Director of Licensing Standards of Practice - Active Play that stipulates a preschool program that operates between 3 and 4 hours must ensure all children have at a minimum 40 minutes of active play. A copy of this document was provided to the facility manager.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: The writer reviewed the children's files and noted staff had flagged some files to indicate that the files were missing one or more of the following: medical insurance plan number, immunization status. In discussion with staff it appears that these files are for individuals who have recently attended the facility.
Corrective Action(s): Staff will continue to ask families for the applicable information.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: The writer reviewed the children's files and saw staff had flagged files that were missing the name and contact information of a medical practitioner.
Corrective Action(s): The staff will continue to ask families for the relevant information. If a family does not have a medical practitioner they may use the name of a medical clinic they would utilize or they may enter "none" on the form.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: Upon review of the children's files the writer noted a file indicates a child in care requires a medical device for a diagnosed medical condition however there was no written direction from the family regarding the administration of the device.
Corrective Action(s): In discussion with the facility staff the family was provided with a document to complete; it was completed during today's inspection.

Comments

The writer provided to and reviewed with the facility manager the Director of Licensing Standards of Practice - Active Play document, the new Order in Council #526 and the resource Live 5210.

The program ended during the inspection and the staff were leaving the premises for their break. The writer had verbally reviewed their inspection findings with the facility staff and agreed to write the report up off site and deliver it later the same day to the staff.
