Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10010 - CCLR s.10(1) - Applicants for licences and licensees must notify a medical health officer immediately of any change in the information provided under section 9.
Observation: Licensing observed that the nap room was being used as a storage room and contained many large pieces of luggage and other items. The Licensee stated the sleep mats/cots are placed in the play area during nap time. The facility was licensed based on the information provided in original floor plans. Licensing was not informed of this change prior to implementation. Children in a family childcare are required to have access to a bedroom as outlined in the Director of Licensing Standards of Practice.
Corrective Action(s): Please ensure that the designated nap room is being used for the children in care. If any changes are made to the original floor plans licensing must be notified prior to this change for approval.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following was observed during the inspection:
-Used diapers were observed in an open waste bin in the washroom.
-Several apples, some half eaten, were observed on the ground in the outdoor play area. An apple tree is located in the yard. In discussion the Licensee states that the birds eat the apples and they fall off the trees. She washes the apples with soap and water and gives these to the children. Apples located on the ground could cause a potential concern for the health and safety of the children in care as the apples could be contaminated from animals or bacteria located on the ground.
Corrective Action(s): Please ensure a covered waste bin is used for used diapers. Please ensure apples that have fallen from the tree and are located on the ground are not provided to the children for consumption due to the potential health risk and contamination from animals or bacteria located on the ground.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following in the outdoor play area:
-A portion of the fence was leaning on an angle. The Licensee has placed a small mesh fence in front of the portion of the
fence to deter children from going near the fence. Please continue to provide active supervision until this is repaired.
This is a repeat contravention from inspection #CLAN-CMXR3B
Corrective Action(s): Please ensure the outdoor fence is in good repair to ensure the continued safety of children in care.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: Three criminal record checks for persons over the age of 12 who are ordinarily present have expired.
Corrective Action(s): Please ensure criminal record checks are renewed prior to the expiry date.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: The fire drill log was observed. A fire drill wasn't completed for the month of October. This is a repeat contravention from inspections# CLAN-CMXR3B, CLAN-CB9VC5 and #CLAN-BQ6UEP
Corrective Action(s): Please ensure fire drills are completed monthly and that this is documented.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: The criminal record check (CRC) was reviewed. The CRC for the Licensee has expired.
Corrective Action(s): Please ensure criminal record checks are current.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Three cloths were observed in the washroom. Four children were present. In discussion the Licensee disclosed the children use cloths and toilet paper to dry their hands. The toilet paper is on the same roll used for toileting.
Corrective Action(s): Please ensure to use individual towels for children or use single use paper towels to ensure there is no cross contamination with the toilet paper used for toileting.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: The attendance was observed. Six days for the months of October and November did not have departure times. This is a repeat contravention from inspections: #CLAN-CMXR3B, #CLAN-BEMP45.
Corrective Action(s): Please ensure arrival and departure times are written on the attendance record each day.

Comments

At the inspection dated November 9, 2023 there were 4 children, and the Licensee was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by November 16, 2023 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Licensee.

The following information was discussed:
-The reportable incident reporting procedure.
-The current cleaning protocols that are in place
-Preventing lead in the water
-Adding supplies to the first-aid kit (CPR mask)
